AMENDMENT TO SENATE BILL 3114 




2    AMENDMENT NO. ______. Amend Senate Bill 3114 on page 72, 
3immediately below line 24, by inserting the following:


4    "(aaaa) Notwithstanding any other provision of this 
5Section to the contrary, nothing in this Section shall prohibit 
6the issuance or renewal of a license authorizing the sale of 
7alcoholic liquor within a restaurant at premises located within 
8a municipality with a population in excess of 1,000,000 
9inhabitants and within 100 feet of a school if:
10        (1) the sale of alcoholic liquor is incidental to the 
11    sale of food and is not the principal business of the 
12    restaurant;
13        (2) the building in which the restaurant is located was 
14    constructed in 1912 and is a 3-story structure;
15        (3) the restaurant has been in operation since 2015 and 
16    its entrance faces North Western Avenue;
17        (4) the  entrance to the school faces West Augusta 
18    Boulevard;

1        (5) the entrance to the restaurant is more than  100 
2    feet from the entrance to the school;
3        (6) the school is a Catholic school affiliated with the 
4    nearby Catholic Parish church;
5        (7) the building in which the restaurant is located and 
6    the building in which the school is located are separated 
7    by an alley;
8        (8) the principal of the school has not indicated his 
9    or her opposition to the issuance or renewal of the license 
10    in writing; and
11        (9) the alderman of the ward in which the restaurant is 
12    located has expressed his or her support for the issuance 
13    or renewal of the license.".
