1 | AN ACT concerning State government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Department of Agriculture Law of the Civil | ||||||
5 | Administrative
Code of Illinois is amended by changing Section | ||||||
6 | 205-15 as follows:
| ||||||
7 | (20 ILCS 205/205-15) (was 20 ILCS 205/40.7 and 205/40.8)
| ||||||
8 | Sec. 205-15. Promotional activities.
| ||||||
9 | (a) The Department has the power to encourage and promote, | ||||||
10 | in every
practicable manner,
the interests of agriculture, | ||||||
11 | including horticulture, the livestock
industry, dairying, | ||||||
12 | cheese making, poultry, bee keeping, forestry, the
production | ||||||
13 | of wool, and all other allied industries. In furtherance of
the | ||||||
14 | duties set forth in this Section, the Department may
establish | ||||||
15 | trust
funds and bank accounts in adequately protected financial | ||||||
16 | institutions
to receive and disburse monies in connection with | ||||||
17 | the conduct of food
shows, food expositions, trade shows, and | ||||||
18 | other promotional activities and
to
sell
at cost, to qualified | ||||||
19 | applicants, signs designating farms that
have been
owned for | ||||||
20 | 100
years
or more,
150 years or more, or 200 years or more
by | ||||||
21 | lineal or collateral descendants of the same family as
| ||||||
22 | "Centennial Farms", "Sesquicentennial Farms", or "Bicentennial | ||||||
23 | Farms" respectively. The
Department shall provide applications |

1 | for the signs, which shall
be submitted
with the
required fee. | ||||||
2 | "Centennial Farms",
"Sesquicentennial Farms", and | ||||||
3 | "Bicentennial Farms"
signs shall not contain within their
| ||||||
4 | design
the name,
picture, or other likeness of any elected | ||||||
5 | public official or any appointed
public official.
| ||||||
6 | (b) The Department has the power to promote improved
| ||||||
7 | methods of conducting the several
industries described in | ||||||
8 | subsection (a) with a view to increasing the
production and | ||||||
9 | facilitating the
distribution thereof at the least cost.
| ||||||
10 | (c) The Department may sell at cost, to qualified | ||||||
11 | applicants, signs designating an agribusiness that has been | ||||||
12 | operated for 100 years or more or more than 150 years or more | ||||||
13 | as the same agribusiness. As used in this subsection (c), | ||||||
14 | "agribusiness" means a business or businesses under the same | ||||||
15 | name or ownership that are collectively associated with the | ||||||
16 | production, processing, or and distribution of agricultural | ||||||
17 | products , or an organization that promotes the economic | ||||||
18 | well-being and expansion of this State's agriculture industry . | ||||||
19 | The Department shall provide applications for the signs, which | ||||||
20 | shall be submitted with the required fee. | ||||||

23 | Section 99. Effective date. This Act takes effect upon | ||||||
24 | becoming law.
