AMENDMENT TO SENATE BILL 2899




2    AMENDMENT NO. ______. Amend Senate Bill 2899 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Surface Coal Mining Land Conservation and 
5Reclamation Act is amended  by changing Section 1.06 as follows:
 



6    (225 ILCS 720/1.06)  (from Ch. 96 1/2, par. 7901.06)



7    Sec. 1.06. Scope of the Act. This Act shall apply to all 
8mining operations, except

9    (a) the private non-commercial extraction of coal by a 
10landowner or lessee
where 250 tons or less of coal are removed 
11in any 12 consecutive months;

12    (b) the extraction of coal incidental to the extraction of 
13other minerals
where the coal does not exceed 16 2/3% of the 
14total mineral tonnage mined;

15    (c) coal exploration on Federal lands; and

16    (d) the extraction of coal on Federal lands except to the

1extent provided
under a cooperative agreement with the United 
2States in accordance with Section 9.03; and .

3    (e)   the extraction of coal as an incidental part of a 
4federal, State, or local government-financed highway or other 
5construction under rules adopted by the Department.

7    Section 99. Effective date. This Act takes effect upon 
8becoming law.".
