SYNOPSIS AS INTRODUCED:

225 ILCS 85/15.3 new

Amends the Pharmacy Practice Act. Provides that a pharmacist may refill a patient's prescription without prescriber authorization if the pharmacist is unable to contact the prescriber after reasonable effort, a failure to refill the prescription may result in an interruption of therapeutic regimen or create patient suffering, the pharmacist informs the prescriber at the earliest convenience of the emergency refills, and the prescription is not for a controlled substance. Provides that prescriptions may be refilled pursuant to the provisions for a period of time reasonably necessary for the pharmacist to secure prescriber authorization. Effective immediately.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Pharmacy Practice Act is amended by adding Section 15.3 as follows:

(225 ILCS 85/15.3 new)

Sec. 15.3. Emergency prescription refills.

(a) A pharmacist may exercise professional judgment by refilling a prescription without prescriber authorization if all of the following are true:

(1) the pharmacist is unable to contact the prescriber after reasonable effort;

(2) a failure to refill the prescription may result in an interruption of therapeutic regimen or create patient suffering;

(3) the pharmacist informs the prescriber at the earliest convenience of the emergency refill; and

(4) the prescription is not for a controlled substance.

(b) Prescriptions may be refilled pursuant to subsection (a) for a period of time reasonably necessary for the pharmacist to secure prescriber authorization.

Section 99. Effective date. This Act takes effect upon becoming law.
