SYNOPSIS AS INTRODUCED:
 
215 ILCS 5/401  from Ch. 73, par. 1013

    Amends the Illinois Insurance Code. Provides that the Director of Insurance shall have the power, in his or her discretion, to grant up to 4 hours of continuing education to a person licensed under the Code who documents, in a form and manner acceptable to the Department of Insurance, membership and active participation in a State or national insurance trade association. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Insurance Code is amended by
5changing Section 401 as follows:
 
6    (215 ILCS 5/401)  (from Ch. 73, par. 1013)
7    Sec. 401. General powers of the director. The Director is
8charged with the rights, powers and duties appertaining to the
9enforcement and execution of all the insurance laws of this
10State. He shall have the power
11        (a) to make reasonable rules and regulations as may be
12    necessary for making effective such laws;
13        (b) to conduct such investigations as may be necessary
14    to determine whether any person has violated any provision
15    of such insurance laws;
16        (c) to conduct such examinations, investigations and
17    hearings in addition to those specifically provided for, as
18    may be necessary and proper for the efficient
19    administration of the insurance laws of this State; and
20        (d) to institute such actions or other lawful
21    proceedings as he may deem necessary for the enforcement of
22    the Illinois Insurance Code or of any Order or action made
23    or taken by him under this Code. The Attorney General, upon

1    request of the Director, may proceed in the courts of this
2    State to enforce an Order or decision in any court
3    proceeding or in any administrative proceeding before the
4    Director; and .
5        (e) to grant up to 4 hours of continuing education, at
6    the discretion of the Director, to a person licensed under
7    this Code who documents, in a form and manner acceptable to
8    the Department, membership and active participation in a
9    State or national insurance trade association.
10    Whenever the Director is authorized or required by law to
11consider some aspect of criminal history record information for
12the purpose of carrying out his statutory powers and
13responsibilities, then, upon request and payment of fees in
14conformance with the requirements of Section 2605-400 of the
15Department of State Police Law (20 ILCS 2605/2605-400), the
16Department of State Police is authorized to furnish, pursuant
17to positive identification, such information contained in
18State files as is necessary to meet the requirements of such
19authorization or statutes.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
