Amends the Liquor Control Act of 1934. Prohibits the possession of any product consisting of or containing powdered alcohol. Provides that a knowing violation of that prohibition is a Class A misdemeanor for a first offense and a Class 4 felony for a second or subsequent offense.

1 | | AN ACT concerning liquor.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Liquor Control Act of 1934 is amended by |
5 | | changing Section 6-34.5 as follows: |
6 | | (235 ILCS 5/6-34.5) |
7 | | Sec. 6-34.5. Powdered alcohol. |
8 | | (a) For the purposes of this Section, "powdered alcohol" |
9 | | means any powder or crystalline substance containing alcohol, |
10 | | as defined in Section 1-3.01 of this Act, produced for human |
11 | | consumption. |
12 | | (b) No person shall possess, sell, offer for sale, or |
13 | | deliver, receive, or purchase for resale in this State any |
14 | | product consisting of or containing powdered alcohol. |
15 | | (c) Any person who knowingly violates this Section is |
16 | | guilty of a Class A misdemeanor for a first offense and a Class |
17 | | 4 felony for a second or subsequent offense.
