Amends the Chicago School District Article of the School Code. In cases of potential sexual abuse or sexual assault by a member of school personnel, prohibits an employee of the school district from conducting a formal investigation or interview of a student unless a local law enforcement officer or a sexual abuse or sexual assault specialist is present. Provides that nothing in the provision prohibits a school district employee from conducting informal investigations of possible cases of sexual abuse or sexual assault. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The School Code is amended by adding Section |
| 5 | | 34-18.60 as follows:
|
| 6 | | (105 ILCS 5/34-18.60 new) |
| 7 | | Sec. 34-18.60. Investigations; sexual abuse or sexual |
| 8 | | assault. In cases of potential sexual abuse or sexual assault |
| 9 | | by a member of school personnel, an employee of the school |
| 10 | | district may not conduct a formal investigation or interview of |
| 11 | | a student unless a local law enforcement officer or a sexual |
| 12 | | abuse or sexual assault specialist is present. Nothing in this |
| 13 | | Section prohibits a school district employee from conducting |
| 14 | | informal investigations of possible cases of sexual abuse or |
| 15 | | sexual assault.

| 16 | | Section 99. Effective date. This Act takes effect upon |
| 17 | | becoming law.
