SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.42 new

    Amends the Chicago School District Article of the School Code. Requires the school board to establish a fund to compensate students who, beginning with the 2007-2008 school year, were subject to sexual abuse or sexual assault. Requires the board to contribute a minimum of $10,000,000 to the fund. Requires the board to advertise the availability of the fund by posting information about the fund on the school district's Internet website, advertising in a newspaper of general circulation in the district, and advertising on social media. Requires the advertisements to include certain information. Provides that the school board shall obtain the State Board of Education's approval regarding the content of the advertisements and regarding the scope of the school board's advertising efforts to ensure that the advertising efforts are, to the extent possible, sufficient to reach as many parents and legal guardians of eligible students as possible. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
534-18.60 as follows:
 
6    (105 ILCS 5/34-18.60 new)
7    Sec. 34-18.60. Fund to compensate students subject to
8sexual abuse or sexual assault.
9    (a) The board shall establish a fund to compensate students
10who, beginning with the 2007-2008 school year, were subject to
11sexual abuse or sexual assault. The board shall contribute a
12minimum of $10,000,000 to the fund.
13    (b) The board shall, at a minimum, advertise the
14availability of the fund by posting information about the fund
15on the school district's Internet website, advertising in a
16newspaper of general circulation in the district, and
17advertising on social media. The advertisements shall include,
18but not be limited to, a description of the fund and its
19purpose and how parents and legal guardians of eligible
20students may seek compensation from the fund. The board shall
21obtain the State Board of Education's approval regarding the
22content of the advertisements and regarding the scope of the
23board's advertising efforts to ensure that the advertising

1efforts are, to the extent possible, sufficient to reach as
2many parents and legal guardians of eligible students as
3possible.
 
4    Section 90. The State Mandates Act is amended by adding
5Section 8.42 as follows:
 
6    (30 ILCS 805/8.42 new)
7    Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8
8of this Act, no reimbursement by the State is required for the
9implementation of any mandate created by this amendatory Act of
10the 100th General Assembly.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
