Amends the Illinois Municipal Code. Provides that no later than January 1, 2019, a municipal police department, including the police department of a home rule municipality, shall employ a full-time licensed clinical social worker or a licensed social worker. Provides that these requirements may be met by the police department of a municipality with a population of less than 20,000 through an intergovernmental agreement with one or more units of local government to jointly employ a full-time social worker. Amends the State Mandates Act to require implementation without reimbursement. Limits home rule powers. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 11-1-10.5 as follows: |

7 | | Sec. 11-1-10.5. Social worker. No later than than January |
8 | | 1, 2019, a municipal police department, including the police |
9 | | department of a home rule municipality, shall employ a |
10 | | full-time licensed clinical social worker or a licensed social |
11 | | worker, as those terms are defined in Section 3 of the Clinical |
12 | | Social Work and Social Work Practice Act. |
13 | | The requirements of this Section may be met by the police |
14 | | department of a municipality with a population of less than |
15 | | 20,000 through an intergovernmental agreement with one or more |
16 | | units of local government to jointly employ a full-time |
17 | | licensed clinical social worker or a licensed social worker. |
18 | | The requirement to hire a full-time social worker by a |
19 | | municipal police department is an exclusive power and function |
20 | | of the State. A home rule municipality may not regulate the |
21 | | requirement to hire a full-time social worker by a police |
22 | | department. This Section is a denial and limitation of home |
23 | | rule powers and functions under subsection (h) of Section 6 of |
