Amends the Illinois Oil and Gas Act. Provides on and after the effective of the bill, a person may not engage in, and the Department of Natural Resources or any other State agency may not issue a permit for, the hydraulic fracturing of a well for exploration or production in the State. Repeals the Hydraulic Fracturing Regulatory Act. Defines "hydraulic fracturing". Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Oil and Gas Act is amended by |
5 | | adding 20.5 as follows: |
6 | | (225 ILCS 725/20.5 new) |
7 | | Sec. 20.5. Well drilling; prohibitions. |
8 | | (a) In this Section, "hydraulic fracturing" means |
9 | | stimulation treatment performed on oil and natural gas wells in |
10 | | low-permeability oil or natural gas reservoirs whereby |
11 | | specially engineered fluids are pumped at high pressure and |
12 | | rate into the reservoir interval to be treated, causing |
13 | | fractures to open. |
14 | | (b) On and after the effective date of this amendatory Act |
15 | | of the 100th General Assembly, a person may not engage in, and |
16 | | the Department of Natural Resources or any other State agency |
17 | | may not issue a permit for, the hydraulic fracturing of a well |
18 | | for exploration or production in this State. |
