AMENDMENT TO HOUSE BILL 5231 




2    AMENDMENT NO. ______. Amend House Bill 5231 by replacing 
3everything after the enacting clause with the following:





 
 
4    "Section 5. The Uniform Peace Officers' Disciplinary Act is 
5amended by changing Section 6 and adding Section 7.2 as 
6follows:
 



7    (50 ILCS 725/6)  (from Ch. 85, par. 2567)



8    Sec. 6. 
Except as otherwise provided in this Act, the The 
9provisions of this Act apply only to the extent there is
no 
10collective bargaining agreement currently in effect dealing 
11with the
subject matter of this Act.

13    (50 ILCS 725/7.2 new)
14    Sec. 7.2. Possession of a Firearm Owner's Identification 
15Card. An employer of an officer shall not make possession of a

1Firearm Owner's Identification Card a condition of continued 
2employment. Nothing is this Section shall otherwise impair an 
3employer's ability to determine an officer's fitness for duty. 
4On and after the effective date of this amendatory Act of the 
5100th General Assembly, Section 6 of this Act shall not apply 
6to the prohibition requiring a Firearm Owner's Identification 
7Card as a condition of continued employment, but a collective 
8bargaining agreement already in effect on   the effective date of 
9this amendatory Act of the 100th General Assembly cannot be 
10modified.
 
 
11    Section 99. Effective date. This Act takes effect upon 
12becoming law.".
