2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Illinois Vehicle Code is amended by changing | |||||||||||||||||||||||||||
5 | Sections 1-126.1, 15-107, 15-116, and 15-316 as follows:

7 | Sec. 1-126.1. Highway Designations. The Department of | |||||||||||||||||||||||||||
8 | Transportation may
designate streets
or
highways in the system | |||||||||||||||||||||||||||
9 | of State highways as follows:
| |||||||||||||||||||||||||||
10 | (a) Class I highways include interstate highways, | |||||||||||||||||||||||||||
11 | expressways, tollways,
and other
highways deemed | |||||||||||||||||||||||||||
12 | appropriate by the Department department .
| |||||||||||||||||||||||||||
13 | (b) Class II highways include major arterials not built | |||||||||||||||||||||||||||
14 | to interstate
highway standards that have at least 11 feet | |||||||||||||||||||||||||||
15 | lane widths.
| |||||||||||||||||||||||||||
16 | (c) (Blank). Class III highways include those State | |||||||||||||||||||||||||||
17 | highways that have lane widths
of less than 11 feet.
| |||||||||||||||||||||||||||
18 | (d) Non-designated highways include those highways | |||||||||||||||||||||||||||
19 | that have lane widths of less than 11 feet, State highways | |||||||||||||||||||||||||||
20 | not designated as Class I or II, and are highways in the | |||||||||||||||||||||||||||
21 | system of State highways
not designated as Class I, II, or | |||||||||||||||||||||||||||
22 | III, or local highways which are part of any
county,
| |||||||||||||||||||||||||||
23 | township, municipal, or district road system not |
| |||||||
| |||||||
1 | designated as Class II . Local authorities also may
| ||||||
2 | designate
Class II or Class III highways within their | ||||||
3 | systems of highways.

6 | Sec. 15-107. Length of vehicles.
| ||||||
7 | (a) The maximum length of a single vehicle on any highway | ||||||
8 | of this State
may not exceed 42 feet except the following:
| ||||||
9 | (1) Semitrailers.
| ||||||
10 | (2) Charter or regulated route buses may be up to 45 | ||||||
11 | feet in length, not
including energy absorbing bumpers.
| ||||||
12 | (a-1) A motor home as defined in Section 1-145.01 may be up | ||||||
13 | to 45 feet
in length, not including energy absorbing bumpers. | ||||||
14 | The length limitations
described in this subsection (a-1) shall | ||||||
15 | be exclusive of energy-absorbing
bumpers and rear view mirrors.
| ||||||
16 | (b) (Blank). On all non-State highways, the maximum length | ||||||
17 | of vehicles in
combinations
is as follows:
| ||||||
18 | (1) A truck tractor in combination with a semitrailer | ||||||
19 | may
not exceed 65 feet overall dimension. An agency or | ||||||
20 | instrumentality of the State of Illinois or any unit of | ||||||
21 | local government shall not be required to widen or | ||||||
22 | otherwise alter a non-State highway constructed before the | ||||||
23 | effective date of this amendatory Act of the 100th General | ||||||
24 | Assembly to accommodate truck tractors under this | ||||||
25 | paragraph (1).

1 | (2) A truck tractor-semitrailer-trailer or truck | ||||||
2 | tractor semitrailer-semitrailer may not exceed 60 feet
| ||||||
3 | overall dimension.
| ||||||
4 | (3) Combinations specially designed to transport motor | ||||||
5 | vehicles or
boats may not exceed 60 feet overall dimension.
| ||||||
6 | (4) The distance between the kingpin and the center | ||||||
7 | axle of a semitrailer longer than 48 feet, in combination | ||||||
8 | with a truck tractor, may not exceed 42 feet 6 inches. The | ||||||
9 | limit contained in this paragraph (4) shall not apply to | ||||||
10 | trailers or semitrailers used for the transport of | ||||||
11 | livestock as defined by Section 18b-101. | ||||||
12 | Vehicles operating during daylight hours when transporting | ||||||
13 | poles, pipes,
machinery, or other objects of a structural | ||||||
14 | nature that cannot readily be
dismembered are exempt from | ||||||
15 | length limitations, provided that no object may
exceed 80 feet | ||||||
16 | in length and the overall dimension of the vehicle including | ||||||
17 | the
load
may not exceed 100 feet. This exemption does not apply | ||||||
18 | to operation on a
Saturday, Sunday, or legal holiday. Legal | ||||||
19 | holidays referred to in this Section
are
the days on which the | ||||||
20 | following traditional holidays are celebrated: New
Year's
Day; | ||||||
21 | Memorial Day; Independence Day; Labor Day; Thanksgiving Day; | ||||||
22 | and
Christmas Day.
| ||||||
23 | Vehicles and loads operated by a public utility while en | ||||||
24 | route to make
emergency repairs to public service facilities or | ||||||
25 | properties are exempt from
length
limitations, provided that | ||||||
26 | during night operations every vehicle and its load
must
be |
| |||||||
| |||||||
1 | equipped with a sufficient number of clearance lamps on both | ||||||
2 | sides and
marker lamps on the extreme ends of any projecting | ||||||
3 | load to clearly mark the
dimensions of the load.
| ||||||
4 | A tow truck in combination with a disabled vehicle or | ||||||
5 | combination of
disabled vehicles, as provided in paragraph (6) | ||||||
6 | of subsection (c) of this
Section, is
exempt from length | ||||||
7 | limitations.
| ||||||
8 | All other combinations not listed in this subsection (b) | ||||||
9 | may not exceed 60
feet overall dimension.
| ||||||
10 | (c) Except as provided in subsections (c-1) and (c-2), | ||||||
11 | combinations of vehicles may not exceed a total of 2 vehicles | ||||||
12 | except
the
following:
| ||||||
13 | (1) A truck tractor semitrailer may draw one trailer.
| ||||||
14 | (2) A truck tractor semitrailer may draw one converter | ||||||
15 | dolly or one semitrailer.
| ||||||
16 | (3) A truck tractor semitrailer may draw one vehicle | ||||||
17 | that is defined
in Chapter 1 as special mobile equipment, | ||||||
18 | provided the overall dimension does
not
exceed 60 feet.
| ||||||
19 | (4) A truck in transit may draw 3 trucks in transit | ||||||
20 | coupled
together by the triple saddlemount method.
| ||||||
21 | (5) Recreational vehicles consisting of 3 vehicles, | ||||||
22 | provided
the following:
| ||||||
23 | (A) The total overall dimension does not exceed 60
| ||||||
24 | feet.
| ||||||
25 | (B) The towing vehicle is a properly registered
| ||||||
26 | vehicle capable of towing another vehicle using a |
| |||||||
| |||||||
1 | fifth-wheel type assembly.
| ||||||
2 | (C) The second vehicle in the combination of | ||||||
3 | vehicles is
a recreational vehicle that is towed by a
| ||||||
4 | fifth-wheel assembly. This vehicle must be
properly | ||||||
5 | registered and must be equipped with
brakes, | ||||||
6 | regardless of weight.
| ||||||
7 | (D) The third vehicle must be the
lightest of the 3 | ||||||
8 | vehicles and be a trailer or
semitrailer designed or | ||||||
9 | used for
transporting a boat, all-terrain vehicle,
| ||||||
10 | personal watercraft, or motorcycle.
| ||||||
11 | (E) The towed vehicles may be only for the use
of | ||||||
12 | the operator of the towing vehicle.
| ||||||
13 | (F) All vehicles must be properly equipped with
| ||||||
14 | operating brakes and safety equipment required by this | ||||||
15 | Code, except the
additional
brake requirement in | ||||||
16 | subdivision (C) of this subparagraph (5).
| ||||||
17 | (6) A tow truck in combination with a disabled vehicle | ||||||
18 | or combination
of
disabled vehicles, provided the towing | ||||||
19 | vehicle:
| ||||||
20 | (A) Is specifically designed as a tow truck having | ||||||
21 | a gross vehicle
weight rating of
at least 18,000 pounds | ||||||
22 | and equipped with air brakes, provided that air brakes
| ||||||
23 | are
required only if the towing vehicle is towing a | ||||||
24 | vehicle, semitrailer, or
tractor-trailer combination | ||||||
25 | that is equipped with air brakes. For the purpose
of | ||||||
26 | this
subsection, gross vehicle weight rating, or GVWR, |
| |||||||
| |||||||
1 | means the value
specified by the manufacturer as the | ||||||
2 | loaded weight of the tow truck.
| ||||||
3 | (B) Is equipped with flashing, rotating, or | ||||||
4 | oscillating amber lights,
visible for at
least 500 feet | ||||||
5 | in all directions.
| ||||||
6 | (C) Is capable of utilizing the lighting and | ||||||
7 | braking systems of the
disabled
vehicle or combination | ||||||
8 | of vehicles.
| ||||||
9 | (D) Does not engage a tow exceeding 50 highway | ||||||
10 | miles from the initial
point of
wreck or disablement to | ||||||
11 | a place of repair. Any additional movement of the
| ||||||
12 | vehicles may occur only upon issuance of authorization | ||||||
13 | for that movement under
the provisions of Sections | ||||||
14 | 15-301 through 15-319 of this Code.
| ||||||
15 | The Department may by rule or regulation prescribe | ||||||
16 | additional
requirements
regarding length limitations for a | ||||||
17 | tow truck towing another vehicle.
| ||||||
18 | For purposes of this Section, a tow-dolly that merely | ||||||
19 | serves as
substitute
wheels for another legally licensed | ||||||
20 | vehicle is considered part of the
licensed
vehicle and not | ||||||
21 | a separate vehicle.
| ||||||
22 | (7) Commercial vehicles consisting of 3 vehicles, | ||||||
23 | provided the following: | ||||||
24 | (A) The total overall dimension does not exceed 65 | ||||||
25 | feet. | ||||||
26 | (B) The towing vehicle is a properly registered |
| |||||||
| |||||||
1 | vehicle capable of towing another vehicle using a | ||||||
2 | fifth-wheel type assembly or a goose-neck hitch ball. | ||||||
3 | (C) The third vehicle must be the lightest of the 3 | ||||||
4 | vehicles and be a trailer or semitrailer. | ||||||
5 | (D) All vehicles must be properly equipped with | ||||||
6 | operating brakes and safety equipment required by this | ||||||
7 | Code.
| ||||||
8 | (E) The combination of vehicles must be operated by | ||||||
9 | a person who holds a commercial driver's license (CDL).
| ||||||
10 | (F) The combination of vehicles must be en route to | ||||||
11 | a location where new or used trailers are sold by an | ||||||
12 | Illinois or out-of-state licensed new or used trailer | ||||||
13 | dealer.
| ||||||
14 | (c-1) A combination of 3 vehicles is allowed access to any | ||||||
15 | State designated highway if: | ||||||
16 | (1) the length of neither towed vehicle exceeds 28.5 | ||||||
17 | feet; | ||||||
18 | (2) the overall wheel base of the combination of | ||||||
19 | vehicles does not exceed 62 feet; and
| ||||||
20 | (3) the combination of vehicles is en route to a | ||||||
21 | location where new or used trailers are sold by an Illinois | ||||||
22 | or out-of-state licensed new or used trailer dealer.
| ||||||
23 | (c-2) A combination of 3 vehicles is allowed access from | ||||||
24 | any State designated highway onto any county, township, or | ||||||
25 | municipal highway for a distance of 5 highway miles for the | ||||||
26 | purpose of delivery or collection of one or both of the towed |
| |||||||
| |||||||
1 | vehicles if: | ||||||
2 | (1) the length of neither towed vehicle exceeds 28.5 | ||||||
3 | feet; | ||||||
4 | (2) the combination of vehicles does not exceed 40,000 | ||||||
5 | pounds in gross weight and 8 feet 6 inches in width; | ||||||
6 | (3) there is no sign prohibiting that access; | ||||||
7 | (4) the route is not being used as a thoroughfare | ||||||
8 | between State designated highways; and
| ||||||
9 | (5) the combination of vehicles is en route to a | ||||||
10 | location where new or used trailers are sold by an Illinois | ||||||
11 | or out-of-state licensed new or used trailer dealer.
| ||||||
12 | (d) On Class I highways there are no overall length | ||||||
13 | limitations on motor
vehicles
operating in combinations | ||||||
14 | provided:
| ||||||
15 | (1) The length of a semitrailer, unladen or with load,
| ||||||
16 | in combination with a truck tractor may not exceed 53 feet.
| ||||||
17 | (2) The distance between the kingpin and the center of
| ||||||
18 | the rear axle of a semitrailer longer than 48 feet, in | ||||||
19 | combination
with a truck tractor, may not exceed 45 feet 6 | ||||||
20 | inches. The limit contained in this paragraph (2) shall not | ||||||
21 | apply to trailers or semi-trailers used for the transport | ||||||
22 | of livestock as defined by Section 18b-101.
| ||||||
23 | (3) The length of a semitrailer or trailer, unladen or
| ||||||
24 | with load, operated in a truck tractor-semitrailer-trailer
| ||||||
25 | or truck tractor semitrailer-semitrailer combination, may | ||||||
26 | not exceed 28 feet 6 inches.

| |||||||
1 | (4) Maxi-cube combinations, as defined in Chapter 1,
| ||||||
2 | may not exceed 65 feet overall dimension.
| ||||||
3 | (5) Combinations of vehicles specifically designed to
| ||||||
4 | transport motor vehicles or boats may not exceed 65 feet
| ||||||
5 | overall dimension. The length limitation is inclusive of
| ||||||
6 | front and rear bumpers but exclusive of the overhang of the
| ||||||
7 | transported vehicles, as provided in paragraph (i) of this
| ||||||
8 | Section.
| ||||||
9 | (6) Stinger-steered semitrailer vehicles specifically | ||||||
10 | designed to transport motor vehicles or
boats and | ||||||
11 | automobile transporters, as defined in Chapter 1, may not | ||||||
12 | exceed 80 feet overall dimension. The length
limitation is | ||||||
13 | inclusive of front and rear bumpers but
exclusive of the | ||||||
14 | overhang of the transported vehicles, as
provided in | ||||||
15 | paragraph (i) of this Section.
| ||||||
16 | (7) A truck in transit transporting 3 trucks coupled
| ||||||
17 | together by the triple saddlemount method may not
exceed 97 | ||||||
18 | feet overall dimension.
| ||||||
19 | (8) A towaway trailer transporter combination may not | ||||||
20 | exceed 82 feet overall dimension. | ||||||

25 | relating to
procedures for rulemaking shall not apply to the | ||||||
26 | designation of highways under
this paragraph (d).

20 | (1) From a Class I highway onto any street or highway | ||||||
21 | for a distance of
one highway mile for the purpose of | ||||||
22 | loading, unloading, food, fuel, repairs,
and rest, | ||||||
23 | provided there is no sign prohibiting that access. | ||||||
24 | (2) From a Class I or Class II highway onto any | ||||||
25 | non-designated highway State highway or any
locally | ||||||
26 | designated highway for a distance of 5 highway miles for |

1 | the purpose
of loading, unloading, food, fuel, repairs, and | ||||||
2 | rest if there is no sign prohibiting access and the route | ||||||
3 | is not being used as a thoroughfare between Class I or | ||||||
4 | Class II highways . | ||||||
5 | (e-3) Combinations of vehicles over 65 feet in length | ||||||
6 | operated by household
goods carriers or towaway trailer | ||||||
7 | transporter combinations, with no overall length limitations | ||||||
8 | except as provided in
subsections (d) and (e) of this Section, | ||||||
9 | have unlimited access to points of
loading,
unloading, or | ||||||
10 | delivery to or from a manufacturer, distributor, or dealer. | ||||||

14 | (1) A truck tractor in combination with a semitrailer | ||||||

17 | overall dimension. An agency or instrumentality of the | ||||||
18 | State of Illinois or any unit of local government shall not | ||||||

9 | trailers or semi-trailers used for the transport of | ||||||
10 | livestock as defined by Section 18b-101.

11 | (g) Length limitations in the preceding subsections of this | ||||||
12 | Section 15-107
do not apply to the following:
| ||||||
13 | (1) Vehicles operated in the daytime, except on | ||||||
14 | Saturdays, Sundays, or
legal holidays, when transporting | ||||||
15 | poles, pipe, machinery, or other objects of a
structural | ||||||
16 | nature that cannot readily be dismembered, provided the | ||||||
17 | overall
length of vehicle and load may not exceed 100 feet | ||||||
18 | and no object exceeding 80
feet in length may be | ||||||
19 | transported unless a permit has been obtained as
authorized | ||||||
20 | in Section 15-301. As used in this Section, "legal holiday" | ||||||
21 | means any of the following days: New Year's Day; Memorial | ||||||
22 | Day; Independence Day; Labor Day; Thanksgiving Day; and | ||||||
23 | Christmas Day.
| ||||||
24 | (2) Vehicles and loads operated by a public utility | ||||||
25 | while en route to make
emergency repairs to public service | ||||||
26 | facilities or properties, but during
night operation every |
| |||||||
| |||||||
1 | vehicle and its load must be equipped with
a
sufficient | ||||||
2 | number of clearance lamps on both sides and marker lamps | ||||||
3 | upon the
extreme ends of any projecting load to clearly | ||||||
4 | mark the dimensions of the load.
| ||||||
5 | (3) A tow truck in combination with a disabled vehicle | ||||||
6 | or combination of disabled vehicles, as provided in | ||||||
7 | paragraph (6) of subsection (c) of this Section, is exempt | ||||||
8 | from length limitations. A tow truck in combination with a | ||||||
9 | disabled vehicle or combination of
disabled vehicles, | ||||||
10 | provided the towing vehicle meets the following | ||||||
11 | conditions:
| ||||||
12 | (A) It is specifically designed as a tow truck | ||||||
13 | having a gross vehicle
weight
rating of at least 18,000 | ||||||
14 | pounds and equipped with air brakes, provided that
air
| ||||||
15 | brakes are required only if the towing vehicle is | ||||||
16 | towing a vehicle,
semitrailer, or tractor-trailer | ||||||
17 | combination that is equipped with air brakes.
| ||||||
18 | (B) It is equipped with flashing, rotating, or | ||||||
19 | oscillating amber lights,
visible for at least 500 feet | ||||||
20 | in all directions.
| ||||||
21 | (C) It is capable of utilizing the lighting and | ||||||
22 | braking systems of the
disabled vehicle or combination | ||||||
23 | of vehicles.
| ||||||
24 | (D) It does not engage in a tow exceeding 50 miles | ||||||
25 | from the initial
point
of wreck or disablement.
| ||||||
26 | The Department may by rule or regulation prescribe |
| |||||||
| |||||||
1 | additional requirements
regarding length limitations for a tow | ||||||
2 | truck towing another vehicle.
The towing vehicle, however, may | ||||||
3 | tow any disabled vehicle from the initial
point of wreck or | ||||||
4 | disablement to a point where repairs are actually to occur.
| ||||||
5 | This movement shall be valid only on State routes.
The tower | ||||||
6 | must abide by posted bridge weight limits.
| ||||||
7 | All other combinations not listed in this subsection (f) | ||||||
8 | may not exceed 60 feet overall dimension. For the purpose of | ||||||
9 | this subsection, gross vehicle weight rating, or GVWR,
shall | ||||||
10 | mean the value specified by the manufacturer as the loaded | ||||||
11 | weight of
the tow truck. Legal holidays referred to in this | ||||||
12 | Section shall be
specified as the day on which the following | ||||||
13 | traditional holidays are
celebrated:
| ||||||
14 | New Year's Day;
| ||||||
15 | Memorial Day;
| ||||||
16 | Independence Day;
| ||||||
17 | Labor Day;
| ||||||
18 | Thanksgiving Day; and
| ||||||
19 | Christmas Day.
| ||||||
20 | (h) The load upon any vehicle operated alone, or the load | ||||||
21 | upon the
front vehicle of a combination of vehicles, shall not | ||||||
22 | extend more than 3
feet beyond the front wheels of the vehicle | ||||||
23 | or the front bumper of the
vehicle if it is equipped with a | ||||||
24 | front bumper.
The provisions of this subsection (h) shall not | ||||||
25 | apply to any vehicle or
combination of vehicles specifically | ||||||
26 | designed for the collection and
transportation of waste, |
| |||||||
| |||||||
1 | garbage, or recyclable materials during the vehicle's
| ||||||
2 | operation in the course of collecting
garbage, waste, or
| ||||||
3 | recyclable materials if the vehicle is traveling at a speed not | ||||||
4 | in
excess of
15 miles per hour during the vehicle's operation | ||||||
5 | and in the course of
collecting garbage, waste, or recyclable | ||||||
6 | materials. However, in no instance
shall the load extend more | ||||||
7 | than 7 feet beyond the front wheels of the vehicle
or the front | ||||||
8 | bumper of the vehicle if it is equipped with a front bumper.
| ||||||
9 | (i) The load upon the front vehicle of an automobile | ||||||
10 | transporter or a stinger-steered vehicle
specifically designed | ||||||
11 | to transport motor vehicles shall not extend more
than 4 feet | ||||||
12 | beyond the foremost part of the transporting vehicle and the
| ||||||
13 | load upon the rear transporting vehicle shall not extend more | ||||||
14 | than 6 feet
beyond the rear of the bed or body of the vehicle. | ||||||
15 | This paragraph shall
only be applicable upon highways | ||||||
16 | designated in paragraphs (d) and (e) of
this Section.
| ||||||
17 | (j) Articulated vehicles comprised of 2 sections, neither | ||||||
18 | of which
exceeds a length of 42 feet, designed for the carrying | ||||||
19 | of more than 10
persons, may be up to 60 feet in length, not | ||||||
20 | including energy absorbing
bumpers, provided that the vehicles | ||||||
21 | are:
| ||||||
22 | 1. operated by or for any public body or motor carrier | ||||||
23 | authorized by law
to provide public transportation | ||||||
24 | services; or
| ||||||
25 | 2. operated in local public transportation service by | ||||||
26 | any other person
and the municipality in which the service |
| |||||||
| |||||||
1 | is to be provided approved the
operation of the vehicle.

3 | (k) Any person who is convicted of violating this Section | ||||||
4 | is subject

12 | (a) The Department of Transportation shall maintain and | ||||||
13 | provide a listing of all Class I and , Class II , and Class III | ||||||
14 | designated streets and highways as defined in Chapter 1 of this | ||||||
15 | Code.

16 | (b) The Department shall also maintain and provide a | ||||||
17 | listing of all local streets or highways that have been | ||||||
18 | designated Class II or Class III by local agencies. | ||||||
19 | (c) Local agencies shall be responsible for reporting to | ||||||
20 | the Department all streets and highways under their | ||||||
21 | jurisdiction designated Class II and Class III . Local agencies | ||||||
22 | shall also provide to the Department reference contact names | ||||||

6 | (f) Each unit of local government shall report to the | ||||||
7 | Department, and the Department shall post on its official | ||||||
8 | website, any limitations prohibiting the operation of vehicles | ||||||
9 | imposed by ordinance or resolution in the unit of local | ||||||
10 | government's non-designated highway system. | ||||||

13 | Sec. 15-316. When the Department or local authority may | ||||||
14 | restrict right to use highways.
| ||||||
15 | (a) Except as provided in subsection (g), local authorities | ||||||
16 | with
respect to highways under their jurisdiction may by | ||||||
17 | ordinance or resolution
prohibit the operation of vehicles upon | ||||||
18 | any such highway or impose
restrictions as to the weight of | ||||||
19 | vehicles to be operated upon any such
highway, for a total | ||||||
20 | period of not to exceed 90 days, measured in either consecutive | ||||||
21 | or nonconsecutive days at the discretion of local authorities, | ||||||
22 | in any one calendar
year, whenever any said highway by reason | ||||||
23 | of deterioration, rain, snow, or
other climate conditions will | ||||||
24 | be seriously damaged or destroyed unless the
use of vehicles | ||||||
25 | thereon is prohibited or the permissible weights thereof

1 | reduced.
| ||||||
2 | (b) The local authority
enacting any such ordinance or | ||||||
3 | resolution shall erect or cause to be erected
and maintained | ||||||
4 | signs designating the provision of the ordinance or resolution
| ||||||
5 | at each end of that portion of any highway affected thereby, | ||||||
6 | and the ordinance
or resolution shall not be effective unless | ||||||
7 | and until such signs are erected
and maintained. To be | ||||||
8 | effective, an ordinance or resolution passed to designate a | ||||||
9 | Class II roadway need not be signed, but shall be reported to | ||||||
10 | the Department.
| ||||||
11 | (c) Local authorities with
respect to highways under their | ||||||
12 | jurisdiction may also, by ordinance or
resolution, prohibit the | ||||||
13 | operation of trucks or other commercial vehicles,
or may impose | ||||||
14 | limitations as the weight thereof, on designated highways, | ||||||
15 | which
prohibitions and limitations shall be designated by | ||||||
16 | appropriate signs placed on
such highways.

17 | (c-1) (Blank).
| ||||||
18 | (c-5) Highway commissioners, with respect to roads under | ||||||
19 | their authority, may not permanently post a road or portion | ||||||
20 | thereof at a reduced weight limit unless the decision to do so | ||||||
21 | is made in accordance with Section 6-201.22 of the Illinois | ||||||
22 | Highway Code. | ||||||
23 | (d) The Department shall likewise have authority as | ||||||
24 | hereinbefore
granted to local authorities to
determine by | ||||||
25 | resolution and to impose restrictions as to the weight of | ||||||
26 | vehicles
operated upon any highway under the jurisdiction of |

1 | said department, and such
restrictions shall be effective when | ||||||
2 | signs giving notice thereof are erected
upon the highway or | ||||||
3 | portion of any highway affected by such resolution.

6 | (e) When any vehicle is operated in violation of this | ||||||
7 | Section, the owner
or driver of the vehicle shall be deemed | ||||||
8 | guilty of a violation and either the
owner or the driver of the | ||||||
9 | vehicle may be prosecuted for the violation. Any
person, firm, | ||||||
10 | or corporation convicted of violating this Section shall be | ||||||
11 | fined
$50 for any weight exceeding the posted limit up to the | ||||||
12 | axle or gross weight
limit allowed a vehicle as provided for in | ||||||
13 | subsections (a) or (b) of Section
15-111 and $75 per every 500 | ||||||
14 | pounds or fraction thereof for any weight
exceeding that which | ||||||
15 | is provided for in subsections (a) or
(b) of Section 15-111.

16 | (f) A municipality is authorized to enforce a county weight | ||||||
17 | limit
ordinance applying to county highways within its | ||||||
18 | corporate limits and is
entitled to the proceeds of any fines | ||||||
19 | collected from the enforcement.
| ||||||
20 | (g) An ordinance or resolution enacted by a county or | ||||||
21 | township pursuant to subsection (a) of this Section shall not | ||||||
22 | apply to cargo tank vehicles with two or three permanent axles | ||||||
23 | when delivering propane for emergency heating purposes if the | ||||||
24 | cargo tank is loaded at no more than 50 percent capacity, the | ||||||
25 | gross vehicle weight of the vehicle does not exceed 32,000 | ||||||
26 | pounds, and the driver of the cargo tank vehicle notifies the |

| |||||||
1 | appropriate agency or agencies with jurisdiction over the | ||||||
2 | highway before driving the vehicle on the highway pursuant to | ||||||
3 | this subsection. The cargo tank vehicle must have an operating | ||||||
4 | gauge on the cargo tank which indicates the amount of propane | ||||||
5 | as a percent of capacity of the cargo tank. The cargo tank must | ||||||
6 | have the capacity displayed on the cargo tank, or documentation | ||||||
7 | of the capacity of the cargo tank must be available in the | ||||||
8 | vehicle. For the purposes of this subsection, propane weighs | ||||||
9 | 4.2 pounds per gallon. This subsection does not apply to | ||||||
10 | municipalities. Nothing in this subsection shall allow cargo | ||||||
11 | tank
vehicles
to cross bridges with posted weight restrictions | ||||||
12 | if the vehicle exceeds the posted weight limit. | ||||||
