SYNOPSIS AS INTRODUCED:

225 ILCS 107/70

    Amends the Clinical Social Work and Social Work Practice Act and the Professional Counselor and Clinical Professional Counselor Licensing and Practice Act. Provides that the Department of Financial and Professional Regulation shall (rather than may) issue a license as a clinical social worker, social worker, professional counselor, or clinical professional counselor, without the required examination, to an applicant licensed under the laws of another jurisdiction if the requirements for licensure in that jurisdiction are, on the date of licensure, substantially equivalent to the requirements under the Act or to any person who, at the time of his or her licensure, possessed individual qualifications that were substantially equivalent to the requirements then in force in this State. Requires the Department to issue the license not more than 60 days after a completed application is received by the Department. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Clinical Social Work and Social Work
5Practice Act is amended by changing Section 12.5 as follows:
 
6    (225 ILCS 20/12.5)
7    (Section scheduled to be repealed on January 1, 2028)
8    Sec. 12.5. Endorsement. The Department shall may issue a
9license as a clinical social worker or as a social worker,
10without the required examination, to an applicant licensed
11under the laws of another jurisdiction if the requirements for
12licensure in that jurisdiction are, on the date of licensure,
13substantially equivalent to the requirements of this Act or to
14any person who, at the time of his or her licensure, possessed
15individual qualifications that were substantially equivalent
16to the requirements then in force in this State. An applicant
17under this Section shall pay the required fees. The Department
18shall issue a license under this Section not more than 60 days
19after a completed application is received by the Department.

1changing Section 70 as follows:

3    (Section scheduled to be repealed on January 1, 2023)
4    Sec. 70. Endorsement. The Department shall may issue a
5license as a licensed professional counselor or licensed
6clinical professional counselor, without the required
7examination, to (i) an applicant licensed under the laws of
8another state or United States jurisdiction whose standards in
9the opinion of the Department, were substantially equivalent at
10the date of his or her licensure in the other jurisdiction to
11the requirements of this Act or (ii) any person who, at the
12time of licensure, possessed individual qualifications which
13were substantially equivalent to the requirements of this Act.
14Such an applicant shall pay all of the required fees. The
15Department shall issue a license under this Section not more
16than 60 days after a completed application is received by the
17Department.
18    Applicants have 3 years from the date of application to
19complete the application process. If the process has not been
20completed within 3 years, the application shall be denied, the
21fee forfeited, and the applicant must reapply and meet the
22requirements in effect at the time of reapplication.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.
