AMENDMENT TO HOUSE BILL 4990

2    AMENDMENT NO. ______. Amend House Bill 4990, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Promotion Act is amended by
6changing Section 8b as follows:
 
7    (20 ILCS 665/8b)
8    Sec. 8b. Municipal convention center and sports facility
9attraction grants.
10    (a) Until July 1, 2022 July 1, 2020, the Department is
11authorized to make grants, subject to appropriation by the
12General Assembly, from the Tourism Promotion Fund to a unit of
13local government, municipal convention center, or convention
14center authority that provides incentives, as defined in
15subsection (i) of Section 3 of this Act, for the purpose of
16attracting conventions, meetings, and trade shows to municipal

1convention centers and attracting sporting events to municipal
2amateur sports facilities. Grants awarded under this Section
3shall be based on the net proceeds received under the Hotel
4Operators' Occupation Tax Act for the renting, leasing, or
5letting of hotel rooms in the municipality for the month in
6which the convention, meeting, trade show, or sporting event
7occurs. Grants shall not exceed 80% of the incentive amount
8provided by the unit of local government, municipal convention
9center, or convention center authority. Further, in no event
10may the aggregate amount of grants awarded to a single
11municipal convention center, convention center authority, or
12municipal amateur sports facility exceed $200,000 in any
13calendar year. The Department may, by rule, require any other
14provisions it deems necessary in order to protect the State's
15interest in administering this program.
16    (b) No later than May 15 of each year, through May 15, 2022
17May 15, 2020, the unit of local government, municipal
18convention center, or convention center authority shall
19certify to the Department the amounts of funds expended in the
20previous fiscal year to provide qualified incentives; however,
21in no event may the certified amount pursuant to this paragraph
22exceed $200,000 for any municipal convention center,
23convention center authority, or municipal amateur sports
24facility in any calendar year. The unit of local government,
25convention center, or convention center authority shall
26certify (A) the net proceeds received under the Hotel

1Operators' Occupation Tax Act for the renting, leasing, or
2letting of hotel rooms in the municipality for the month in
3which the convention, meeting, or trade show occurs and (B) the
4average of the net proceeds received under the Hotel Operators'
5Occupation Tax Act for the renting, leasing, or letting of
6hotel rooms in the municipality for the same month in the 3
7immediately preceding years. The unit of local government,
8municipal convention center, or convention center authority
9shall include the incentive amounts as part of its regular
10audit.
11    (b-5) Grants awarded to a unit of local government,
12municipal convention center, or convention center authority
13may be made by the Department of Commerce and Economic
14Opportunity from appropriations for those purposes for any
15fiscal year, without regard to the fact that the qualification
16or obligation may have occurred in a prior fiscal year.
17    (c) The Department shall submit a report, which must be
18provided electronically, on the effectiveness of the program
19established under this Section to the General Assembly no later
20than January 1, 2022 January 1, 2020.
