1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Promotion Act is amended by
5changing Section 8b as follows:
 
6    (20 ILCS 665/8b)
7    Sec. 8b. Municipal convention center and sports facility
8attraction grants.
9    (a) Until July 1, 2022 July 1, 2020, the Department is
10authorized to make grants, subject to appropriation by the
11General Assembly, from the Tourism Promotion Fund to a unit of
12local government, municipal convention center, or convention
13center authority that provides incentives, as defined in
14subsection (i) of Section 3 of this Act, for the purpose of
15attracting conventions, meetings, and trade shows to municipal
16convention centers and attracting sporting events to municipal
17amateur sports facilities. Grants awarded under this Section
18shall be based on the net proceeds received under the Hotel
19Operators' Occupation Tax Act for the renting, leasing, or
20letting of hotel rooms in the municipality for the month in
21which the convention, meeting, trade show, or sporting event
22occurs. Grants shall not exceed 80% of the incentive amount
23provided by the unit of local government, municipal convention

1center, or convention center authority. Further, in no event
2may the aggregate amount of grants awarded to a single
3municipal convention center, convention center authority, or
4municipal amateur sports facility exceed $200,000 in any
5calendar year. The Department may, by rule, require any other
6provisions it deems necessary in order to protect the State's
7interest in administering this program.
8    (b) No later than May 15 of each year, through May 15, 2022
9May 15, 2020, the unit of local government, municipal
10convention center, or convention center authority shall
11certify to the Department the amounts of funds expended in the
12previous fiscal year to provide qualified incentives; however,
13in no event may the certified amount pursuant to this paragraph
14exceed $200,000 for any municipal convention center,
15convention center authority, or municipal amateur sports
16facility in any calendar year. The unit of local government,
17convention center, or convention center authority shall
18certify (A) the net proceeds received under the Hotel
19Operators' Occupation Tax Act for the renting, leasing, or
20letting of hotel rooms in the municipality for the month in
21which the convention, meeting, or trade show occurs and (B) the
22average of the net proceeds received under the Hotel Operators'
23Occupation Tax Act for the renting, leasing, or letting of
24hotel rooms in the municipality for the same month in the 3
25immediately preceding years. The unit of local government,

1shall include the incentive amounts as part of its regular
2audit.
3    (b-5) Grants awarded to a unit of local government,
4municipal convention center, or convention center authority
5may be made by the Department of Commerce and Economic
6Opportunity from appropriations for those purposes for any
7fiscal year, without regard to the fact that the qualification
8or obligation may have occurred in a prior fiscal year.
9    (c) The Department shall submit a report, which must be
10provided electronically, on the effectiveness of the program
11established under this Section to the General Assembly no later
12than January 1, 2022 January 1, 2020.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
