1 | | AN ACT concerning regulation.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Surface Coal Mining Land Conservation and |
5 | | Reclamation Act is amended by changing Section 1.06 as follows:
|
6 | | (225 ILCS 720/1.06) (from Ch. 96 1/2, par. 7901.06)
|
7 | | Sec. 1.06. Scope of the Act. This Act shall apply to all |
8 | | mining operations, except
|
9 | | (a) the private non-commercial extraction of coal by a |
10 | | landowner or lessee
where 250 tons or less of coal are removed |
11 | | in any 12 consecutive months;
|
12 | | (b) the extraction of coal incidental to the extraction of |
13 | | other minerals
where the coal does not exceed 16 2/3% of the |
14 | | total mineral tonnage mined;
|
15 | | (c) coal exploration on Federal lands; and
|
16 | | (d) the extraction of coal on Federal lands except to the |
17 | | extent provided
under a cooperative agreement with the United |
18 | | States in accordance with Section 9.03 ; and .
|
19 | | (e) the extraction of coal incidental to the development or |
20 | | operation of a sanitary landfill as defined in the |
21 | | Environmental Protection Act. |
