2 | | AMENDMENT NO. ______. Amend House Bill 4643 on page 1, by |
3 | | replacing line 5 with the following:

4 | | "changing Sections 1 and 17 and by adding Section 1.2 as |
5 | | follows:"; and |
6 | | on page 3, by replacing line 6 with the following: |
7 | | " and establishing a physical therapy treatment plan pursuant to |
8 | | such license."; and |
9 | | on page 3, by replacing lines 9 through 15 with the following: |
10 | | "she is educated and licensed to perform. A physical therapist |
11 | | shall refer to a licensed physician, advanced practice |
12 | | registered nurse, physician assistant, dentist, podiatric |
13 | | physician, other physical therapist, or other health care |
14 | | provider any patient whose medical condition should, at the |
15 | | time of evaluation or treatment, be determined to be beyond the |
16 | | scope of practice of the physical therapist. "; and |

1 | | on page 4, by replacing lines 6 through 14 with the following: |
2 | | "(7) (Blank). "Documented current and relevant diagnosis" |
3 | | for the purposes of this Act means a diagnosis, substantiated |
4 | | by signature or oral verification of a physician, dentist, |
5 | | advanced practice registered nurse, physician assistant, or |
6 | | podiatric physician, that a patient's condition is such that it |
7 | | may be treated by physician therapy as defined in this Act, |
8 | | which diagnosis shall remain in effect until changed by the |
9 | | physician, dentist, advanced practice registered nurse, |
10 | | physician assistant, or podiatric physician. "; and |
11 | | on page 5, immediately below line 9, by inserting the |
12 | | following: |
13 | | " (13) "Health care professional" means a physician, |
14 | | dentist, podiatric physician, advanced practice registered |
15 | | nurse, or physician assistant. "; and |
16 | | on page 5, immediately below line 12, by inserting the |
17 | | following: |
18 | | "(225 ILCS 90/1.2 new) |
19 | | Sec. 1.2. Physical therapy services. |
20 | | (a) A physical therapist may provide physical therapy |
21 | | services to a patient with or without a referral from a health |
22 | | care professional. |

1 | | (b) A physical therapist providing services without a |
2 | | referral from a health care professional must notify the |
3 | | patient's treating health care professional within 5 business |
4 | | days after the patient's first visit that the patient is |
5 | | receiving physical therapy. This does not apply to physical |
6 | | therapy services related to fitness or wellness, unless the |
7 | | patient presents with an ailment or injury. |
8 | | (c) A physical therapist shall refer a patient to the |
9 | | patient's treating health care professional of record or, in |
10 | | the case where there is no health care professional of record, |
11 | | to a health care professional of the patient's choice, if: |
12 | | (1) the patient does not demonstrate measurable or |
13 | | functional improvement after 10 visits or 15 business days, |
14 | | whichever occurs first; |
15 | | (2) the patient returns for services for the same or |
16 | | similar condition after 30 calendar days of being |
17 | | discharged by the physical therapist; or |
18 | | (3) the patient's condition, at the time of evaluation |
19 | | or services, is determined to be beyond the scope of |
20 | | practice of the physical therapist. |
21 | | (d) Wound debridement services may only be provided by a |
22 | | physical therapist with written authorization from a health |
23 | | care professional. |
24 | | (e) A physical therapist will consult and collaborate with |
25 | | the appropriate health care professionals on conditions |
26 | | related to temporomandibular disorder. "; and |

1 | | by replacing line 21 on page 9 through line 3 on page 10 with |
2 | | the following: |
3 | | "licensed physical therapist in violation of Section 1.2 |
4 | | independent of a documented referral or a documented current |
5 | | and relevant diagnosis from a physician, dentist, advanced |
6 | | practice registered nurse, physician assistant, or podiatric |
7 | | physician, or having failed to notify the physician, dentist, |
8 | | advanced practice registered nurse, physician assistant, or |
9 | | podiatric physician who established a documented current and |
10 | | relevant diagnosis that the patient is receiving physical |
11 | | therapy pursuant to that diagnosis ;".
