Amends the Election Code. Provides that the Electronic Registration Information Center shall provide the exclusive interstate voter registration program for the State. Provides that the State Board of Elections shall not share identification records contained in databases maintained by State agencies with any interstate voter registration program other than the Electronic Registration Information Center. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Election Code is amended by changing Section |
5 | | 1A-45 as follows: |
6 | | (10 ILCS 5/1A-45) |
7 | | Sec. 1A-45. Electronic Registration Information Center. |
8 | | (a) The State Board of Elections shall enter into an |
9 | | agreement with the Electronic Registration Information Center |
10 | | effective no later than January 1, 2016, for the purpose of |
11 | | maintaining a statewide voter registration database. The |
12 | | Electronic Registration Information Center shall provide the |
13 | | exclusive interstate voter registration program for the State |
14 | | of Illinois. The State Board of Elections shall comply with the |
15 | | requirements of the Electronic Registration Information Center |
16 | | Membership Agreement. The State Board of Elections shall |
17 | | require a term in the Electronic Registration Information |
18 | | Center Membership Agreement that requires the State to share |
19 | | identification records contained in the Secretary of State's |
20 | | Driver Services Department and Vehicle Services Department, |
21 | | the Department of Human Services, the Department of Healthcare |
22 | | and Family Services, the Department of Aging, and the |
23 | | Department of Employment Security databases (excluding those |

1 | | fields unrelated to voter eligibility, such as income or health |
2 | | information). |
3 | | (b) The Secretary of State and the Board of Elections shall |
4 | | enter into an agreement to permit the Secretary of State to |
5 | | provide the State Board of Elections with any information |
6 | | required for compliance with the Electronic Registration |
7 | | Information Center Membership Agreement. The Secretary of |
8 | | State shall deliver this information as frequently as necessary |
9 | | for the State Board of Elections to comply with the Electronic |
10 | | Registration Information Center Membership Agreement. |
11 | | (b-5) The State Board of Elections and the Department of |
12 | | Human Services, the Department of Healthcare and Family |
13 | | Services, the Department on Aging, and the Department of |
14 | | Employment Security shall enter into an agreement to require |
15 | | each department to provide the State Board of Elections with |
16 | | any information necessary to transmit member data under the |
17 | | Electronic Registration Information Center Membership |
18 | | Agreement. The director or secretary, as applicable, of each |
19 | | agency shall deliver this information on an annual basis to the |
20 | | State Board of Elections pursuant to the agreement between the |
21 | | entities. |
22 | | (b-10) The State Board of Elections shall not share |
23 | | identification records contained in databases maintained by |
24 | | the Secretary of State's Driver Services Department and Vehicle |
25 | | Services Department, the Department of Human Services, the |
26 | | Department of Healthcare and Family Services, the Department of |

1 | | Aging, the Department of Employment Security, or any other |
2 | | State database containing identification records with any |
3 | | interstate voter registration program other than the |
4 | | Electronic Registration Information Center. |
5 | | (c) Any communication required to be delivered to a |
6 | | registrant or potential registrant pursuant to the Electronic |
7 | | Registration Information Center Membership Agreement shall |
8 | | include at least the following message: |
9 | | "Our records show people at this address may not be |
10 | | registered to vote at this address, but you may be eligible |
11 | | to register to vote or re-register to vote at this address. |
12 | | If you are a U.S. Citizen, a resident of Illinois, and will |
13 | | be 18 years old or older before the next general election |
14 | | in November, you are qualified to vote. |
15 | | We invite you to check your registration online at |
16 | | (enter URL) or register to vote online at (enter URL), by |
17 | | requesting a mail-in voter registration form by (enter |
18 | | instructions for requesting a mail-in voter registration |
19 | | form), or visiting the (name of election authority) office |
20 | | at (address of election authority)." |
21 | | The words "register to vote online at (enter URL)" shall be |
22 | | bolded and of a distinct nature from the other words in the |
23 | | message required by this subsection (c). |
24 | | (d) Any communication required to be delivered to a |
25 | | potential registrant that has been identified by the Electronic |
26 | | Registration Information Center as eligible to vote but who is |

1 | | not registered to vote in Illinois shall be prepared and |
2 | | disseminated at the direction of the State Board of Elections. |
3 | | All other communications with potential registrants or |
4 | | re-registrants pursuant to the Electronic Registration |
5 | | Information Center Membership Agreement shall be prepared and |
6 | | disseminated at the direction of the appropriate election |
7 | | authority. |
8 | | (e) The Executive Director of the State Board of Elections |
9 | | or his or her designee shall serve as the Member Representative |
10 | | to the Electronic Registration Information Center. |
11 | | (f) The State Board of Elections may adopt any rules |
12 | | necessary to enforce this Section or comply with the Electronic |
13 | | Registration Information Center Membership Agreement.

15 | | Section 90. The State Mandates Act is amended by adding |
16 | | Section 8.42 as follows: |
17 | | (30 ILCS 805/8.42 new) |
18 | | Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8 |
19 | | of this Act, no reimbursement by the State is required for the |
20 | | implementation of any mandate created by this amendatory Act of |
21 | | the 100th General Assembly.

22 | | Section 99. Effective date. This Act takes effect upon |
23 | | becoming law.
