Amends the Fire Protection District Act. In provisions regarding fixing, charging, and collecting fees for services rendered by a fire district against persons, businesses, and other entities who are not residents of the fire protection district, provides that additional charges may be levied to reimburse the district for equipment and apparatus utilized in response to the call for assistance where it can be demonstrated by the district that the additional equipment or apparatus was needed in the circumstances presented, but the rate per vehicle shall not exceed $100 per hour. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Fire Protection District Act is amended by |
5 | | changing Section 11f as follows:
|

7 | | Sec. 11f. Charge against non-residents.
|
8 | | (a) The board of trustees of a fire protection district may
|
9 | | fix, charge, and collect fees not exceeding the reasonable cost |
10 | | of the
service for all services rendered by the district |
11 | | against persons,
businesses and other entities who are not |
12 | | residents of the fire protection
district.
|
13 | | (b) Such charge may not be assessed against residents of
|
14 | | the fire protection district or
persons who request fire |
15 | | protection coverage for an unprotected area and who
pay to the |
16 | | fire protection district an amount equal to the district's Fire
|
17 | | Protection Tax pursuant to Section 4 of the Fire Protection of |
18 | | Unprotected
Area Act.

19 | | (c) The charge for such services shall be computed at a
|
20 | | rate not to exceed $250
per hour and not to exceed $70 per hour |
21 | | per firefighter
responding to a call
for assistance. An |
