SYNOPSIS AS INTRODUCED:
 
15 ILCS 335/8  from Ch. 124, par. 28
15 ILCS 335/12  from Ch. 124, par. 32

    Amends the Illinois Identification Card Act. Provides that every original, renewal, or duplicate non-Real ID identification card issued to a person who has reached his or her 65th birthday shall be permanent and need not be renewed. Provides that every original, renewal, or duplicate non-Real ID Illinois Person with a Disability Identification Card issued to a qualifying person shall expire 10 years thereafter. Removes a specified fee in connection with the issuance of Illinois Identification Cards. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Identification Card Act is amended
5by changing Sections 8 and 12 as follows:
 
6    (15 ILCS 335/8)  (from Ch. 124, par. 28)
7    Sec. 8. Expiration.
8    (a) Except as otherwise provided in this Section:
9        (1) Every identification card issued hereunder, except
10    to persons who have reached their 15th birthday, but are
11    not yet 21 years of age, persons who are 65 years of age or
12    older, and persons who are issued an Illinois Person with a
13    Disability Identification Card, shall expire 5 years from
14    the ensuing birthday of the applicant and a renewal shall
15    expire 5 years thereafter.
16        (2) Every original or renewal identification card
17    issued to a person who has reached his or her 15th
18    birthday, but is not yet 21 years of age shall expire 3
19    months after the person's 21st birthday.
20    (b) Except as provided elsewhere in this Section, every
21original, renewal, or duplicate: (i) non-Real ID
22identification card issued prior to July 1, 2017, to a person
23who has reached his or her 65th birthday shall be permanent and

1need not be renewed; (ii) REAL ID compliant identification card
2issued on or after July 1, 2017, to a person who has reached
3his or her 65th birthday shall expire 8 years thereafter; (iii)
4non-Real ID Illinois Person with a Disability Identification
5Card issued prior to July 1, 2017, to a qualifying person shall
6expire 10 years thereafter; and (iv) REAL ID compliant Illinois
7Person with a Disability Identification Card issued on or after
8July 1, 2017, shall expire 8 years thereafter. The Secretary of
9State shall promulgate rules setting forth the conditions and
10criteria for the renewal of all Illinois Person with a
11Disability Identification Cards.
12    (c) Every identification card or Illinois Person with a
13Disability Identification Card issued under this Act to an
14applicant who is not a United States citizen or permanent
15resident shall be marked "Limited Term" and shall expire on
16whichever is the earlier date of the following:
17        (1) as provided under subsection (a) or (b) of this
18    Section;
19        (2) on the date the applicant's authorized stay in the
20    United States terminates; or
21        (3) if the applicant's authorized stay is indefinite
22    and the applicant is applying for a Limited Term REAL ID
23    compliant identification card, one year from the date of
24    issuance of the card.

3Cards. The fees required under this Act for standard Illinois
4Identification Cards must accompany any application provided
5for in this Act, and the Secretary shall collect such fees as
6follows:

23    All fees collected under this Act shall be paid into the
24Road Fund of the State treasury, except that the following
25amounts shall be paid into the General Revenue Fund: (i) 80% of
26the fee for an original, renewal, or duplicate Illinois

1Identification Card issued on or after January 1, 2005; and
2(ii) 80% of the fee for a corrected Illinois Identification
3Card issued on or after January 1, 2005.
4    An individual, who resides in a veterans home or veterans
5hospital operated by the State or federal government, who makes
6an application for an Illinois Identification Card to be issued
7at no fee, must submit, along with the application, an
8affirmation by the applicant on a form provided by the
9Secretary of State, that such person resides in a veterans home
10or veterans hospital operated by the State or federal
11government.
12    The application of a homeless individual for an Illinois
13Identification Card to be issued at no fee must be accompanied
14by an affirmation by a qualified person, as defined in Section
154C of this Act, on a form provided by the Secretary of State,
16that the applicant is currently homeless as defined in Section
171A of this Act.
18    For the application for the first Illinois Identification
19Card of a youth for whom the Department of Children and Family
20Services is legally responsible or a foster child to be issued
21at no fee, the youth must submit, along with the application,
22an affirmation by his or her court appointed attorney or an
23employee of the Department of Children and Family Services on a
24form provided by the Secretary of State, that the person is a
25youth for whom the Department of Children and Family Services
26is legally responsible or a foster child.

1    The fee for any duplicate identification card shall be
2waived for any person who presents the Secretary of State's
3Office with a police report showing that his or her
4identification card was stolen.
5    The fee for any duplicate identification card shall be
6waived for any person age 60 or older whose identification card
7has been lost or stolen.
8    As used in this Section, "active-duty member of the United
9States Armed Forces" means a member of the Armed Services or
10Reserve Forces of the United States or a member of the Illinois
11National Guard who is called to active duty pursuant to an
12executive order of the President of the United States, an act
13of the Congress of the United States, or an order of the
14Governor.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.
