| 2 | AMENDMENT NO. ______. Amend House Bill 4396 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Unified Code of Corrections is amended by | ||||||
| 5 | changing Section 3-5-3 as follows:
| ||||||
| 6 | (730 ILCS 5/3-5-3) (from Ch. 38, par. 1003-5-3)
| ||||||
| 7 | Sec. 3-5-3. Annual and other Reports.
| ||||||
| 8 | (a) The Director shall make an annual report to the | ||||||
| 9 | Governor and General Assembly concerning persons committed to | ||||||
| 10 | the Department, its
institutions, facilities and programs, of | ||||||
| 11 | all moneys expended and received,
and on what accounts expended | ||||||
| 12 | and received. The report shall include the ethnic and racial | ||||||
| 13 | background data, not identifiable to an individual, of all | ||||||
| 14 | persons committed to the Department, its institutions, | ||||||
| 15 | facilities, and programs.
| ||||||
| 16 | (b) (Blank).

| 1 | (c) The Director may require such reports from division | ||||||
| 2 | administrators,
chief administrative officers and other | ||||||
| 3 | personnel as he deems necessary for
the administration of the | ||||||
| 4 | Department.
| ||||||
| 5 | (d) (Blank).
| ||||||
| 6 | (e) The Director shall make quarterly reports to the | ||||||
| 7 | Governor and the General Assembly concerning each
incident of | ||||||
| 8 | assault by a committed person toward Department of Corrections | ||||||
| 9 | staff. These reports shall specify the
facility where the | ||||||
| 10 | incident occurred, the classification of offender that | ||||||
| 11 | committed the assault, and the
nature of the injury to the | ||||||
| 12 | staff member, if any. | ||||||
| 13 | (f)
The Director shall make quarterly reports to the | ||||||
| 14 | Governor and the General Assembly concerning the use
of force | ||||||
| 15 | incidents administered by Department of Corrections staff on | ||||||
| 16 | persons committed to the Department. The
reports shall specify | ||||||
| 17 | the facility where the incident occurred, the classification of | ||||||
| 18 | the offender that was the
recipient of the use of force, and | ||||||
| 19 | the nature of the injury, if any. | ||||||
