1 | AN ACT concerning transportation.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Vehicle Code is amended by changing | ||||||
5 | Section 8-102 and by adding Section 3-414.5 as follows: | ||||||
6 | (625 ILCS 5/3-414.5 new) | ||||||
7 | Sec. 3-414.5. Multi-year registration. | ||||||
8 | (a) The Secretary may, in his or her discretion, permit the | ||||||
9 | owner of a motor vehicle of the first division, a motor vehicle | ||||||
10 | of the second division weighing not more than 8,000 pounds, or | ||||||
11 | a motor vehicle of the second division applying for a C Class | ||||||
12 | registration plate to register the motor vehicle for a period | ||||||
13 | of 2 years. | ||||||
14 | (1) If the vehicle to be registered is required to | ||||||
15 | undergo emissions inspections, the 2-year registration | ||||||
16 | must coincide with the emissions inspection cycle. | ||||||
17 | (2) An applicant for a 2-year registration shall apply | ||||||
18 | online or by completing and mailing the appropriate 2-year | ||||||
19 | registration application form to the address indicated on | ||||||
20 | the form. | ||||||
21 | (3) The owner of a vehicle with a 2-year registration | ||||||
22 | may transfer that registration to another vehicle with the | ||||||
23 | same emissions inspection cycle, if applicable. The owner |

1 | of a vehicle with a 2-year registration who discontinues | ||||||
2 | use of the registration before the expiration of the 2-year | ||||||
3 | period is not entitled to a complete or prorated refund of | ||||||
4 | the registration fee. | ||||||
5 | (4) The fee for a 2-year registration shall be twice | ||||||
6 | the applicable annual registration fee for the vehicle | ||||||
7 | being registered. | ||||||
8 | If a vehicle issued a registration under this subsection is | ||||||
9 | subject to an annual surcharge under Section 3-806 or 3-815, | ||||||
10 | the Secretary shall collect the surcharge for each registration | ||||||
11 | year of the multi-year registration at the same time the | ||||||
12 | Secretary collects the one-time registration fee. | ||||||
13 | (b) Beginning January 1, 2021, the Secretary shall permit | ||||||
14 | the owner of a trailer to register the trailer for a period of | ||||||
15 | one year or for an extended registration period of up to 5 | ||||||
16 | years. | ||||||
17 | (1) The extended trailer registration shall be based on | ||||||
18 | a recurring 5-year registration period. The trailer owner | ||||||
19 | may apply for an extended registration for the number of | ||||||
20 | years remaining in the current 5-year cycle at the time of | ||||||
21 | the registration application. | ||||||
22 | (2) An applicant for an extended trailer registration | ||||||
23 | shall apply online or by completing and mailing the | ||||||
24 | appropriate extended trailer registration application form | ||||||
25 | to the address indicated on the form. | ||||||
26 | (3) The owner of a trailer with an extended |

2 | trailer of the same weight class. The owner of a trailer | ||||||
3 | with an extended registration who discontinues use of the | ||||||
4 | registration before the registration period expires is not | ||||||
5 | entitled to a complete or prorated refund of the | ||||||
6 | registration fee. | ||||||
7 | (4) The fee for an extended registration shall be the | ||||||
8 | same as the applicable annual registration fee for the | ||||||
9 | trailer being registered, multiplied by the number of years | ||||||
10 | or partial years remaining in the current 5-year cycle at | ||||||
11 | the time of the registration application. | ||||||
12 | (c) The Secretary of State may adopt rules to implement | ||||||
13 | this Section.

15 | Sec. 8-102. Alternate methods of giving proof. | ||||||
16 | (a) Except as provided in subsection (b), proof Proof of | ||||||
17 | financial
responsibility, when required under Section 8-101 or | ||||||
18 | 8-101.1, may be given
by filing with the Secretary of State one | ||||||
19 | of the following:
| ||||||
20 | 1. A bond as provided in Section 8-103;
| ||||||
21 | 2. An insurance policy or other proof of insurance in a | ||||||
22 | form to be
prescribed by the Secretary as provided in | ||||||
23 | Section 8-108;
| ||||||
24 | 3. A certificate of self-insurance issued by the | ||||||
25 | Director;

| |||||||
1 | 4. A certificate of self-insurance issued to the | ||||||
2 | Regional Transportation
Authority by the Director naming | ||||||
3 | municipal or non-municipal public carriers
included | ||||||
4 | therein;
| ||||||
5 | 5. A certificate of coverage issued by an | ||||||
6 | intergovernmental risk management
association evidencing | ||||||
7 | coverages which meet or exceed the amounts required
under | ||||||
8 | this Code. | ||||||
9 | (b) Beginning January 1, 2020, in lieu of filing the | ||||||
10 | documents required by subsection (a), each owner of a vehicle | ||||||
11 | required to obtain minimum liability insurance under Section | ||||||
12 | 8-101 or 8-101.1 shall attest that the vehicle is insured in at | ||||||
13 | least the minimum required amount. | ||||||
14 | (1) The Secretary shall create a form on which the | ||||||
15 | vehicle owner shall attest that the vehicle is insured in | ||||||
16 | at least the minimum required amount. The attestation form | ||||||
17 | shall be submitted with each registration application. | ||||||
18 | (2) The attestation form shall be valid for the full | ||||||
19 | registration period; however, if at any time the Secretary | ||||||
20 | has reason to believe that the owner does not have the | ||||||
21 | minimum required amount of insurance for a vehicle, the | ||||||
22 | Secretary may require the owner to file with the Secretary | ||||||
23 | documentation as set forth in subsection (a) of this | ||||||
24 | Section. | ||||||
25 | (3) If the owner fails to provide the required | ||||||
26 | documentation within 7 calendar days after the request is |

1 | made, the Secretary may suspend the vehicle registration. | ||||||
2 | The registration shall remain suspended until such time as | ||||||
3 | the required documentation is provided to and reviewed by | ||||||
4 | the Secretary. | ||||||
5 | (4) The owner of a vehicle that is self-insured shall | ||||||
6 | attest that the funds available to pay liability claims | ||||||
7 | related to the operation of the vehicle are equivalent to | ||||||
8 | or greater than the minimum liability insurance | ||||||
9 | requirements under Section 8-101 or 8-101.1.

10 | (c) The Secretary of State may adopt rules to implement | ||||||
11 | this Section. | ||||||

13 | Section 99. Effective date. This Act takes effect January | ||||||
14 | 1, 2020.
