Amends the Good Samaritan Act. Provides that any not-for-profit organization in this State or any person working at the organization who in good faith provides temporary or emergency overnight shelter without fee to a person experiencing homelessness shall not be liable for civil damages as a result of acts or omissions, except for willful or wanton misconduct on the part of the person or organization in providing the temporary or emergency overnight shelter. Provides that the new provisions do not apply to an organization whose primary purpose is to provide shelter to the homeless.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Good Samaritan Act is amended by adding |
5 | | Section 77 as follows: |
6 | | (745 ILCS 49/77 new) |
7 | | Sec. 77. Temporary overnight shelters; exemption from |
8 | | civil liability. Any not-for-profit organization in this State |
9 | | or any person working at the organization who in good faith |
10 | | provides temporary or emergency overnight shelter without fee |
11 | | to a person experiencing homelessness shall not be liable for |
12 | | civil damages as a result of acts or omissions, except for |
13 | | willful or wanton misconduct on the part of the person or |
14 | | organization in providing the temporary or emergency overnight |
15 | | shelter. |
16 | | This Section does not apply to an organization whose |
17 | | primary purpose is to provide shelter to the homeless.
