Amends the State Finance Act if and only if Senate Bill 482 of the 100th General Assembly becomes law as amended by House Amendment 2. Provides that grants from the State Aviation Program Fund to a municipality with a population of over 500,000 may be made (i) for the replacement of sound-reducing windows and doors installed at an eligible address (instead of installed under the Residential Sound Insulation Program); and (ii) for in-home air quality testing at those residences. Effective immediately or on the date Senate Bill 482 of the 100th General Assembly takes effect, whichever is later.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. If and only if Senate Bill 482 of the 100th |
5 | | General Assembly becomes law as amended by House Amendment 2, |
6 | | then the State Finance Act is amended by changing Section |
7 | | 6z-20.1 as follows: |
8 | | (30 ILCS 105/6z-20.1) |
9 | | Sec. 6z-20.1. The State Aviation Program Fund. |
10 | | (a) The State Aviation Program Fund is created in the State |
11 | | Treasury. Moneys in the Fund shall be used by the Department of |
12 | | Transportation for the purposes of administering a State |
13 | | Aviation Program. Subject to appropriation, the moneys shall be |
14 | | used for the purpose of distributing grants to units of local |
15 | | government to be used for airport-related purposes. Grants to |
16 | | units of local government from the Fund shall be distributed |
17 | | proportionately based on enplanements. With regard to |
18 | | enplanements that occur within a municipality with a population |
19 | | of over 500,000, grants shall be distributed only to the |
20 | | municipality. |
21 | | (b) For grants to a municipality with a population of over |
22 | | 500,000, "airport-related purposes" means: (1) the replacement |
23 | | of sound-reducing windows and doors installed at residences |

1 | | located at an eligible address under the Residential Sound |
2 | | Insulation Program ; and (2) in-home air quality testing at |
3 | | those residences in residences in which windows or doors were |
4 | | installed under the Residential Sound Insulation Program . |
5 | | (c) For grants to a unit of government other than a |
6 | | municipality with a population of over 500,000, |
7 | | "airport-related purposes" means the capital or operating |
8 | | costs of: (1) an airport; (2) a local airport system; or (3) |
9 | | any other local facility that is owned or operated by the |
10 | | person or entity that owns or operates the airport that is |
11 | | directly and substantially related to the air transportation of |
12 | | passengers or property as provided in 49 U.S.C. §47133.

13 | | (d) As used in this Section, "eligible address" means any |
14 | | address located (i) within the 65 DNL Build-Out Contour for |
15 | | O'Hare International Airport, as defined by rules adopted by |
16 | | the Federal Aviation Administration, (ii) within the 65 annual |
17 | | CNEL zone indicated on the noise contour map submitted with the |
18 | | permanent noise monitoring report for O'Hare International |
19 | | Airport under the Permanent Noise Monitoring Act, using the |
20 | | most recent noise contour map available on the date the |
21 | | sound-reducing windows or doors were installed, or (iii) not |
22 | | more than 20 miles east or west and not more than 3 miles north |
23 | | or south of an airport runway aligned in an east-west direction |
24 | | and located at O'Hare International Airport. |
