New Act
10000SB0031enr, Secs. 1 through 20 rep.

     Creates the Sanctuary City Sanction Act. Provides that if a unit of local government has in place any policy that limits or restricts compliance with immigration detainers issued by the Secretary of Homeland Security or otherwise does not comply with an immigration detainer, all grants of State funds that the unit of local government would otherwise receive will not be distributed to the unit of local government until any policy that limits or restricts compliance with an immigration detainer is abolished and compliance with immigration detainers is demonstrated by the unit of local government.  Defines terms. Repeals the Illinois TRUST Act. Effective immediately.

1    AN ACT concerning local government.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 1. Short title. This Act may be cited as the 
5Sanctuary City Sanction Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Immigration detainer" means any order or request relating 
8to undocumented persons whose immigration status is in question 
9by the Secretary of Homeland Security to a unit of local 
10government official:

11        (1) to temporarily hold a person in the custody of a 
12    unit of local government until the person may be taken into 
13    federal custody;
14        (2) to transport the person for transfer to federal 
15    custody; or
16        (3) to notify the Secretary of Homeland Security prior 
17    to the release of such a person.
18    "State funds" includes, but is not limited to, a unit of 
19local government's local share of the state income tax from the 
20Local Government Distributive Fund, a unit of local 
21government's local share of Corporate Personal Property 
22Replacement Tax, and a unit of local government's local share 
23of sales tax.

1    Section 10. Failure to comply with immigration detainers. 
2Notwithstanding any other provision of law, if a unit of local 
3government has in place any policy that limits or restricts 
4compliance with immigration detainers or otherwise does not 
5comply with an immigration detainer, all grants of State funds 
6that the unit of local government would otherwise receive will 
7not be distributed to that unit of local government until any 
8policy that limits or restricts compliance with an immigration 
9detainer is abolished and compliance with immigration 
10detainers is demonstrated by the unit of local government.

12    Section 900. The Illinois TRUST Act is repealed.
 
13    Section 999. Effective date. This Act takes effect upon 
14becoming law.
