Amends the River Edge Redevelopment Zone Act. Provides that, on and after the effective date of the amendatory Act, a River Edge Redevelopment Zone means an area of the State (1) located on a river, (2) with less than 20,000 population, (3) that meets one of the following conditions: (i) has a median household income of less than 80% of State median income for a household of 4, as determined by the U.S. Department of Housing and Urban Development; (ii) has a per capita personal income of less than 60% of the per capita personal income for Illinois as determined by the U.S. Department of Commerce; or (iii) has a median home price of less than 60% of the State median home price, and (3) is certified by the Department of Commerce and Economic Opportunity (currently, an area of the State certified by the Department). Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:
|
4 | | Section 5. The River Edge Redevelopment Zone Act is amended |
5 | | by changing Section 10-3 as follows: |
6 | | (65 ILCS 115/10-3)

7 | | Sec. 10-3. Definitions. As used in this Act: |
8 | | "Department" means the Department of Commerce and Economic |
9 | | Opportunity. |
10 | | "River Edge Redevelopment Zone" means , before the |
11 | | effective date of this amendatory Act of the 100th General |
12 | | Assembly, an area of the State certified by the Department as a |
13 | | River Edge Redevelopment Zone pursuant to this Act. On and |
14 | | after the effective date of this amendatory Act of the 100th |
15 | | General Assembly, "River Edge Redevelopment Zone" means an area |
16 | | of the State (1) located on a river, (2) with less than 20,000 |
17 | | population, (3) that meets one of the following conditions: (i) |
18 | | has a median household income of less than 80% of State median |
19 | | income for a household of 4, as determined by the U.S. |
20 | | Department of Housing and Urban Development; (ii) has a per |
21 | | capita personal income of less than 60% of the per capita |
22 | | personal income for Illinois as determined by the U.S. |
23 | | Department of Commerce; or (iii) has a median home price of |

2 | | certified by the Department. |
3 | | "Designated zone organization" means an association or |
4 | | entity: (1) the members of which are substantially all |
5 | | residents of the River Edge Redevelopment Zone or of the |
6 | | municipality in which the River Edge Redevelopment Zone is |
7 | | located; (2) the board of directors of which is elected by the |
8 | | members of the organization; (3) that satisfies the criteria |
9 | | set forth in Section 501(c) (3) or 501(c) (4) of the Internal |
10 | | Revenue Code; and (4) that exists primarily for the purpose of |
11 | | performing within the zone, for the benefit of the residents |
12 | | and businesses thereof, any of the functions set forth in |
13 | | Section 8 of this Act. |
14 | | "Agency" means: each officer, board, commission, and |
15 | | agency created by the Constitution, in the executive branch of |
16 | | State government, other than the State Board of Elections; each |
17 | | officer, department, board, commission, agency, institution, |
18 | | authority, university, and body politic and corporate of the |
19 | | State; each administrative unit or corporate outgrowth of the |
20 | | State government that is created by or pursuant to statute, |
21 | | other than units of local government and their officers, school |
22 | | districts, and boards of election commissioners; and each |
23 | | administrative unit or corporate outgrowth of the above and as |
24 | | may be created by executive order of the Governor. No entity is |
25 | | an "agency" for the purposes of this Act unless the entity is |
26 | | authorized by law to make rules or regulations. |

1 | | "Rule" means each agency statement of general |
2 | | applicability that implements, applies, interprets, or |
3 | | prescribes law or policy, but does not include (i) statements |
4 | | concerning only the internal management of an agency and not |
5 | | affecting private rights or procedures available to persons or |
6 | | entities outside the agency, (ii) intra-agency memoranda, or |
7 | | (iii) the prescription of standardized forms.

9 | | Section 99. Effective date. This Act takes effect upon |
10 | | becoming law.
