SYNOPSIS AS INTRODUCED:
 
5 ILCS 430/20-52

    Amends the State Officials and Employees Ethics Act. Provides that the Executive Inspector General may make a summary report and response of the ultimate jurisdictional authority or agency head available to the public if the Executive Ethics Commission does not do so. Provides that, prior to publication by the Executive Inspector General, the Executive Inspector General shall permit the respondents, the Commission, and the Attorney General to review the documents to be made public and offer suggestions for redaction or provide a response that shall be made public with the summary report.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Officials and Employees Ethics Act is
5amended by changing Section 20-52 as follows:
 
6    (5 ILCS 430/20-52)
7    Sec. 20-52. Release of summary reports.
8    (a) Within 60 days after receipt of a summary report and
9response from the ultimate jurisdictional authority or agency
10head that resulted in a suspension of at least 3 days or
11termination of employment, the Executive Ethics Commission
12shall make available to the public the report and response or a
13redacted version of the report and response. The Executive
14Ethics Commission may make available to the public any other
15summary report and response of the ultimate jurisdictional
16authority or agency head or a redacted version of the report
17and response. If the Executive Ethics Commission does not make
18a summary report and response of the ultimate jurisdictional
19authority or agency head available to the public, the Executive
20Inspector General responsible for the investigation and report
21may make a summary report and response of the ultimate
22jurisdictional authority or agency head available to the
23public.

1    (b) The Commission or Executive Inspector General shall
2redact information in the summary report that may reveal the
3identity of witnesses, complainants, or informants or if the
4Commission or Executive Inspector General determines it is
5appropriate to protect the identity of a person before the
6report is made public. The Commission or Executive Inspector
7General may also redact any information it believes should not
8be made public. Prior to publication by the Commission, the
9Commission shall permit the respondents, Executive Inspector
10General, and Attorney General to review documents to be made
11public and offer suggestions for redaction or provide a
12response that shall be made public with the summary report.
13Prior to publication by the Executive Inspector General, the
14Executive Inspector General shall permit the respondents, the
15Commission, and the Attorney General to review the documents to
16be made public and offer suggestions for redaction or provide a
17response that shall be made public with the summary report.
18    (c) The Commission may withhold publication of the report
19or response if the Executive Inspector General or Attorney
20General certifies that releasing the report to the public will
21interfere with an ongoing investigation.
