Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a merchant to impose a surcharge, transaction charge, or other additional fee upon a transaction involving the use of a credit card when the amount of the transaction before the imposition of taxes and any other fee is less than $5.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Consumer Fraud and Deceptive Business |
5 | | Practices Act is amended by adding Section 2TTT new as follows: |
6 | | (815 ILCS 505/2TTT new) |
7 | | Sec. 2TTT new. Limitation on credit card transactions fees. |
8 | | (a) In this Section: |
9 | | "Credit card" has the meaning ascribed to it in Section 2NN |
10 | | of this Act. |
11 | | "Merchant" has the meaning ascribed to it in Section 2JJ of |
12 | | this Act. |
13 | | (b) It is an unlawful practice for a merchant to impose a |
14 | | surcharge, transaction charge, or other additional fee upon a |
15 | | transaction involving the use of a credit card when the amount |
16 | | of the transaction before the imposition of taxes and any other |
17 | | fee is less than $5.
