SYNOPSIS AS INTRODUCED:
 
70 ILCS 3615/2.04  from Ch. 111 2/3, par. 702.04

    Amends the Regional Transportation Authority Act. Provides that for a customer who uses a credit card or bank card to purchase a ticket or card containing fares from a Service Board, including, but not limited to, Ventra tickets and cards, the Service Board shall refund, upon request, non-expired tickets or cards by transferring the remaining fares to a new ticket or card or by issuing a refund of the remaining fares. Provides that in order to be eligible for a refund, an individual shall show proof of purchase of the ticket or card and shall also present the credit card or bank card that purchased the lost ticket or card.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Regional Transportation Authority Act is
5amended by changing Section 2.04 as follows:
 
6    (70 ILCS 3615/2.04)  (from Ch. 111 2/3, par. 702.04)
7    Sec. 2.04. Fares and Nature of Service.
8    (a) Whenever a Service Board provides any public
9transportation by operating public transportation facilities,
10the Service Board shall provide for the level and nature of
11fares or charges to be made for such services, and the nature
12and standards of public transportation to be so provided that
13meet the goals and objectives adopted by the Authority in the
14Strategic Plan. Provided, however that if the Board adopts a
15budget and financial plan for a Service Board in accordance
16with the provisions in Section 4.11(b)(5), the Board may
17consistent with the terms of any purchase of service contract
18provide for the level and nature of fares to be made for such
19services under the jurisdiction of that Service Board, and the
20nature and standards of public transportation to be so
21provided.
22    (b) Whenever a Service Board provides any public
23transportation pursuant to grants made after June 30, 1975, to

1transportation agencies for operating expenses (other than
2with regard to experimental programs) or pursuant to any
3purchase of service agreement, the purchase of service
4agreement or grant contract shall provide for the level and
5nature of fares or charges to be made for such services, and
6the nature and standards of public transportation to be so
7provided. A Service Board shall require all transportation
8agencies with which it contracts, or from which it purchases
9transportation services or to which it makes grants to provide
10half fare transportation for their student riders if any of
11such agencies provide for half fare transportation to their
12student riders.
13    (c) In so providing for the fares or charges and the nature
14and standards of public transportation, any purchase of service
15agreements or grant contracts shall provide, among other
16matters, for the terms or cost of transfers or interconnections
17between different modes of transportation and different public
18transportation agencies, schedules or routes of such service,
19changes which may be made in such service, the nature and
20condition of the facilities used in providing service, the
21manner of collection and disposition of fares or charges, the
22records and reports to be kept and made concerning such
23service, for interchangeable tickets or other coordinated or
24uniform methods of collection of charges, and shall further
25require that the transportation agency comply with any
26determination made by the Board of the Authority under and

1subject to the provisions of Section 2.12b of this Act. In
2regard to any such service, the Authority and the Service
3Boards shall give attention to and may undertake programs to
4promote use of public transportation and to provide coordinated
5ticket sales and passenger information. In the case of a grant
6to a transportation agency which remains subject to Illinois
7Commerce Commission supervision and regulation, the Service
8Boards shall exercise the powers set forth in this Section in a
9manner consistent with such supervision and regulation by the
10Illinois Commerce Commission.
11    (d) By January 1, 2013, the Authority, in consultation with
12the Service Boards and the general public, must develop a
13policy regarding transfer fares on all fixed-route public
14transportation services provided by the Service Boards. The
15policy shall also set forth the fare sharing agreements between
16the Service Boards that apply to interagency fare passes and
17tickets. The policy established by the Authority shall be
18submitted to each of the Service Boards for its approval or
19comments and objection. After receiving the policy, the Service
20Boards have 90 days to approve or take other action regarding
21the policy. If all of the Service Boards agree to the policy,
22then a regional agreement shall be created and signed by each
23of the Service Boards. The terms of the agreement may be
24changed upon petition by any of the Service Boards and by
25agreement of the other Service Boards.
26    (e) By January 1, 2015, the Authority must develop and

1implement a regional fare payment system. The regional fare
2payment system must use and conform with established
3information security industry standards and requirements of
4the financial industry. The system must allow consumers to use
5contactless credit cards, debit cards, and prepaid cards to pay
6for all fixed-route public transportation services. Beginning
7in 2012 and each year thereafter until 2015, the Authority must
8submit an annual report to the Governor and General Assembly
9describing the progress of the Authority and each of the
10Service Boards in implementing the regional fare payment
11system. The Authority must adopt rules to implement the
12requirements set forth in this Section.
13    (f) For a customer who uses a credit card or bank card to
14purchase a ticket or card containing fares from a Service
15Board, including, but not limited to, Ventra tickets and cards,
16the Service Board shall refund, upon request, non-expired
17tickets or cards by transferring the remaining fares to a new
18ticket or card or by issuing a refund of the remaining fares.
19In order to be eligible for a refund, an individual shall show
20proof of purchase of the ticket or card and shall also present
21the credit card or bank card that purchased the lost ticket or
22card.
