1 | AN ACT concerning safety.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the Flue | ||||||
5 | Gas Desulfurization (FGD) Task Force Act. | ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "FGD" means flue gas desulfurization and other | ||||||
8 | technologies that can be used to lower sulfur dioxide | ||||||
9 | emissions. | ||||||
10 | "Task Force" means the FGD Task Force
| ||||||
11 | Section 10. The FGD Task Force. | ||||||
12 | (a) The FGD Task Force is hereby created to increase the | ||||||
13 | amount of Illinois Basin coal use in generation units. The FGD | ||||||
14 | Task Force shall identify and evaluate the costs, benefits, and | ||||||
15 | barriers of new and modified FGD, or other post-combustion | ||||||
16 | sulfur dioxide emission control technologies, and other | ||||||
17 | capital improvements, that would be necessary for generation | ||||||
18 | units to comply with the sulfur dioxide National Ambient Air | ||||||
19 | Quality Standards (NAAQS) while improving the ability of those | ||||||
20 | generation units to meet the effluent limitation guidelines | ||||||
21 | (ELGs) for wastewater discharges and enhancing the | ||||||
22 | marketability of the generation units' FGD byproducts. |

1 | (b) The membership of the Task Force shall be as follows: | ||||||
2 | (1) Two members of the Senate appointed by the | ||||||
3 | President of the Senate. | ||||||
4 | (2) Two members of the Senate appointed by the Minority | ||||||
5 | Leader of the Senate.

6 | (3) Two members of the House of appointed by the | ||||||
7 | Speaker of the House of Representatives. | ||||||
8 | (4) Two members of the House of Representatives | ||||||
9 | appointed by the Minority Leader of the House of | ||||||
10 | Representatives. | ||||||
11 | (5) Three members appointed by the Governor, two with | ||||||
12 | expertise in Illinois coal, coal mining, emission | ||||||
13 | reduction, or energy production; and one representative of | ||||||
14 | an electricity generator that owns multiple coal-fueled | ||||||
15 | electric generation plants with FGD or similar | ||||||
16 | technologies. | ||||||
17 | (6) The Director of Natural Resources, or his or her | ||||||
18 | designee. | ||||||
19 | (7) The Director of the Environmental Protection | ||||||
20 | Agency, or his or her designee. | ||||||
21 | (c) Task Force members shall serve without compensation but | ||||||
22 | shall be reimbursed for travel expenses incurred in performing | ||||||
23 | their duties. | ||||||
24 | (d) The Task Force shall report their findings and | ||||||
25 | recommendations to the General Assembly by December 31, 2017.

1 | Section 15. Administrative support. The Department of | ||||||
2 | Natural Resources and the Illinois Environmental Protection | ||||||
3 | Agency shall provide administrative and other support to the | ||||||
4 | Task Force. | ||||||
5 | Section 20. Repeal. This Act is repealed on January 1, | ||||||
6 | 2019.

7 | Section 99. Effective date. This Act takes effect upon | ||||||
8 | becoming law.
