2 | | AMENDMENT NO. ______. Amend House Bill 3274 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The State Fair Act is amended by changing |
5 | | Sections 6 and 10 as follows:
|
6 | | (20 ILCS 210/6) (from Ch. 127, par. 1706)

7 | | Sec. 6. Policies, procedures, and powers concerning the |
8 | | operation of fairs.
|
9 | | (a) Policies. The Department shall, pursuant to the |
10 | | Illinois Administrative Procedure Act, establish by rule: |
11 | | (1) the policy for the operation
of the Illinois State |
12 | | Fair and the DuQuoin State Fair, except those operations |
13 | | regarding contests as provided for in subparagraphs (b) and |
14 | | (c) of this Section, and |
15 | | (2) the
policies and procedures for the sale, barter, |
16 | | or exchange of tickets and
for ticket refunds for cancelled |

|
2 | | (b) Contests. The Department shall establish and make |
3 | | available, for all contestants and other interested persons, |
4 | | sufficient copies of a premium book or other publication that |
5 | | establishes the kinds and classes of events or exhibits for |
6 | | contests at the fairs, the conditions under which contestants |
7 | | shall be entered into contests, the qualification and |
8 | | disqualification requirements of contests, the drug testing |
9 | | requirements for contests (if applicable), the premiums to be |
10 | | offered to contest winners, the manner in which certificates of |
11 | | award shall be distributed and premiums paid to contest |
12 | | winners, the penalty for violations of a rule, condition, |
13 | | instruction, or directive, and requirements of contests, |
14 | | including but not limited to the return of all premiums paid, |
15 | | the forfeiture of awards, and the prohibition of participating |
16 | | in future contests, and all other rules and requirements for |
17 | | contests. These rules, conditions, instructions, directives, |
18 | | and requirements shall be exempt from the rulemaking procedures |
19 | | of the Illinois Administrative Procedure Act. All such |
20 | | publications issued by the Department that relate to a contest, |
21 | | event, or exhibit shall be maintained as a public record at the |
22 | | Department's principal office in Springfield, Illinois, and |
23 | | made available for public inspection and copying during regular |
24 | | business hours.

25 | | (c) Fees. The Department shall establish and publish for |
26 | | the Illinois State Fair and
the DuQuoin State Fair a schedule |

1 | | of admission fees, entry fees, concession
fees, space rentals |
2 | | and other fees for activities offered or provided at each
State |
3 | | Fair. These schedules of fees shall be maintained as a public |
4 | | record at the Department's principal office in Springfield, |
5 | | Illinois, and made available for public inspection and copying |
6 | | during regular business, but shall be exempt from the |
7 | | rulemaking procedures of the Illinois Administrative Procedure |
8 | | Act. |
9 | | (d) Facilities. The Department may negotiate and enter
into |
10 | | contracts for activities and use of facilities for which there |
11 | | is not an
established or published schedule. The contract |
12 | | criteria shall be established
by rule, pursuant to the Illinois |
13 | | Administrative Procedure Act. The Department may lease any of |
14 | | its facilities for activities during
the State Fair.

15 | | (e) Advertising. The Illinois State Fair in Springfield and |
16 | | the DuQuoin State Fair shall
have the power and authority to |
17 | | sell or exchange advertising rights in all of
its publications |
18 | | and printed materials. The sale of advertising shall be
subject |
19 | | to the rules promulgated by the Department, pursuant to the |
20 | | Illinois Administrative Procedure Act. All income derived from
|
21 | | the sale of advertising at the Illinois State Fair in |
22 | | Springfield and the DuQuoin State Fair shall be
deposited into |
23 | | the State Fair Fund. All income derived from the sale of
|
24 | | advertising at the DuQuoin State Fair shall be deposited into |
25 | | the Agricultural
Premium Fund.

26 | | (f) Veterans. On the day set aside as Veterans Day, |

1 | | honorably discharged veterans and
members of their families |
2 | | shall be admitted without admission charge upon
presentation of |
3 | | identification of any of the following: honorable discharge
|
4 | | certificate, or photostatic copy thereof, or a paid up |
5 | | membership card in
any recognized veterans organization.
|
6 | | (g) Government functions. The Governor, Lieutenant |
7 | | Governor, Attorney General, Secretary of
State, Treasurer, |
8 | | Comptroller, President and Minority Leader of the Senate,
and |
9 | | Minority Leader of the House of Representatives shall be |
10 | | afforded space for
official governmental functions, without |
11 | | charge, during the State Fair and the
DuQuoin State Fair.

14 | | Sec. 10.
The Department may enter into contracts with other |
15 | | government
agencies to assist them in the operation of each |
16 | | State Fair and the State
Fairgrounds as well as the |
17 | | requirements set forth in Section 9 of this Act.

18 | | The Department may cooperate with any other local, State or |
19 | | federal agency
in the furtherance of the intent of this Act.
|
20 | | The Department may receive and use any donation either from |
21 | | the private
or public sectors which is for betterment of each |
22 | | State Fair
and the State Fairgrounds.
|
23 | | All revenues from the operation and use of any facilities |
24 | | of the Illinois
State Fair at Springfield , and the Springfield |
25 | | State
Fairgrounds , the DuQuoin State Fair, and the DuQuoin |

1 | | State Fairgrounds shall be deposited in the Illinois State Fair |
2 | | Fund. All revenues
from the operation and use of any facilities |
3 | | of the DuQuoin State Fair and the
DuQuoin State Fairgrounds |
4 | | shall be deposited into the Agricultural Premium
Fund. All |
5 | | funds in the Illinois State Fair Fund shall be used by the
|
6 | | Department of Agriculture in accordance with appropriation by |
7 | | the General
Assembly for operation of the Illinois State Fair |
8 | | and the DuQuoin State Fair .
