2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Department of Public Health Powers and |
5 | | Duties Law of the
Civil Administrative Code of Illinois is |
6 | | amended by changing Section 2310-650 as follows: |
7 | | (20 ILCS 2310/2310-650) |
8 | | Sec. 2310-650. Influenza vaccination program. |
9 | | (a) As used in this Section, "medically contraindicated" |
10 | | means that administration of an influenza vaccine to an |
11 | | employee would likely be detrimental to the employee's health. |
12 | | (b) The Department of Public Health may require any |
13 | | facility licensed by the Department to implement an influenza |
14 | | vaccination program that ensures that the employees of the |
15 | | facility are offered the opportunity to be vaccinated against |
16 | | seasonal influenza and any other novel or pandemic influenza |
17 | | viruses as vaccines become available. The Department may adopt |
18 | | rules setting forth the requirements of the influenza |
19 | | vaccination program. A health care employee may decline the |
20 | | offer of vaccination if the vaccine is medically |
21 | | contraindicated, if the vaccination is against the employee's |
22 | | religious beliefs, or if the employee has already been |
23 | | vaccinated. General philosophical or moral reluctance to |
