AMENDMENT TO HOUSE BILL 2958

2    AMENDMENT NO. ______. Amend House Bill 2958 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5adding Section 52.6 as follows:
 
6    (415 ILCS 5/52.6 new)
7    Sec. 52.6. Coal tar and high PAH sealant use and sale
8prohibited.
9    (a) As used in this Section:
10    "Coal tar sealant product" means a surface applied sealing
11product containing any amount of coal tar, coal tar pitch, coal
12tar pitch volatiles, or any variation assigned the Chemical
13Abstracts Service (CAS) numbers 65996-93-2, 65996-89-6, or
148007-45-2.
15    "High PAH sealant product" means a surface applied sealing
16product that contains greater than 0.1% polycyclic aromatic

1hydrocarbons (PAHs) by weight, including, but not limited to,
2coal tar pitch volatiles, tar, fuel oil, petroleum, or asphalt.
3    (b) On and after January 1, 2018, no person may knowingly
4cause or allow sale at wholesale or retail of a coal tar
5sealant product or high PAH sealant product.
6    (c) On and after July 1, 2019, no person may knowingly
7cause or allow application of a coal tar sealant product or
8high PAH sealant product on any surface, except for highway
9structures, in the State of Illinois, including, but not
10limited to, a driveway, parking area, playground, sidewalk,
11bike trail or roadway.
12    (d) A municipality or county may adopt ordinances providing
13for enforcement of the requirements of subsections (b) or (c)
14of this Section with penalties as provided in subsection (e). A
15municipality or county adopting an ordinance under this
16subsection (d) has jurisdiction concurrent with the Agency to
17enforce this Section.
18    (e) Any violation of this Section shall be enforceable by
19administrative citation. Penalties under this Section may not
20exceed $1,000 for the first offense and $5,000 for the second
21offense.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.".
