1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Pedestrians with Disabilities Safety Act is | ||||||
5 | amended by changing Sections 5 and 20 as follows: | ||||||
6 | (625 ILCS 60/5)
| ||||||
7 | Sec. 5. Definitions. For purposes of this Act: | ||||||
8 | "Mobility device" means a support cane, walker, crutches, | ||||||
9 | wheelchair, scooter, or other device, which may be necessary | ||||||
10 | for use by a pedestrian with a disability when traveling.
| ||||||
11 | "Pedestrian with a disability" means a person with a | ||||||
12 | disability, as defined by the Americans with Disabilities Act, | ||||||
13 | who may require the use of a mobility device, service animal, | ||||||
14 | or white cane to travel on the streets, sidewalks, highways, | ||||||
15 | and walkways , and walking, running, or bicycle paths of this | ||||||
16 | State.

17 | "Service animal" means a service animal as defined by the | ||||||
18 | Code of Federal Regulations (28 CFR 36.104).
| ||||||
19 | "White cane" means a cane that is predominantly white or | ||||||
20 | metallic in color, with or without a red tip, that is held in | ||||||
21 | an extended or raised position.

2 | Sec. 20. Proclamation. Each year, the Governor is | ||||||
3 | authorized and requested to designate and take suitable public | ||||||
4 | notice of Pedestrians with Disabilities Safety Day (October 15) | ||||||
5 | and to issue a proclamation which:
| ||||||
6 | (1) comments upon the necessity for and significance of | ||||||
7 | the Pedestrians with Disabilities Safety Act and discusses | ||||||
8 | the history of laws protecting pedestrians with | ||||||
9 | disabilities ;
| ||||||
10 | (2) calls upon the citizens of the State to observe the | ||||||
11 | provisions of the Pedestrians with Disabilities Safety Act | ||||||
12 | and to take precautions necessary for the safety of | ||||||
13 | pedestrians with disabilities;
| ||||||
14 | (3) reminds the citizens of the State of the policies | ||||||
15 | with respect to persons with disabilities and urges all | ||||||
16 | citizens to ensure that the policies are upheld;
and | ||||||
17 | (4) emphasizes the need of all citizens to be aware of | ||||||
18 | the presence of persons with disabilities in the community | ||||||
19 | and to keep safe and functional for persons with | ||||||
20 | disabilities the streets, sidewalks, highways, and | ||||||
21 | walkways , and walking, running, or bicycle paths of this | ||||||
22 | State.
