SYNOPSIS AS INTRODUCED:
 
20 ILCS 2905/2  from Ch. 127 1/2, par. 2
20 ILCS 3985/3001  from Ch. 127, par. 3853-1

    Amends the State Fire Marshal Act. Provides that the Office of the State Fire Marshal shall administer grants (currently, General Revenue Fund grants) to areas not located in a fire protection district or in a municipality which provides fire protection services, to defray the organizational expenses of forming a fire protection district. Amends the Law Enforcement and Fire Fighting Medal of Honor Act. Provides that members of the Fire Fighting Medal of Honor Committee shall serve without compensation but shall be reimbursed for actual expenses incurred in the performance of their duties from funds appropriated to the Office of the State Fire Marshal (currently, Office of the Governor) for such purpose. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Fire Marshal Act is amended by
5changing Section 2 as follows:
 
6    (20 ILCS 2905/2)  (from Ch. 127 1/2, par. 2)
7    Sec. 2. The Office shall have the following powers and
8duties:
9        1. To exercise the rights, powers and duties which have
10    been vested by law in the Department of State Police as the
11    successor of the Department of Public Safety, State Fire
12    Marshal, inspectors, officers and employees of the State
13    Fire Marshal, including arson investigation. Arson
14    investigations conducted by the State Fire Marshal's
15    Office shall be conducted by State Fire Marshal Arson
16    Investigator Special Agents, who shall be peace officers as
17    provided in the Peace Officer Fire Investigation Act.
18        2. To keep a record, as may be required by law, of all
19    fires occurring in the State, together with all facts,
20    statistics and circumstances, including the origin of
21    fires.
22        3. To exercise the rights, powers and duties which have
23    been vested in the Department of State Police by the

1    "Boiler and Pressure Vessel Safety Act", approved August 7,
2    1951, as amended.
3        4. To administer the Illinois Fire Protection Training
4    Act.
5        5. To aid in the establishment and maintenance of the
6    training facilities and programs of the Illinois Fire
7    Service Institute.
8        6. To disburse Federal grants for fire protection
9    purposes to units of local government.
10        7. To pay to or in behalf of the City of Chicago for
11    the maintenance, expenses, facilities and structures
12    directly incident to the Chicago Fire Department training
13    program. Such payments may be made either as reimbursements
14    for expenditures previously made by the City, or as
15    payments at the time the City has incurred an obligation
16    which is then due and payable for such expenditures.
17    Payments for the Chicago Fire Department training program
18    shall be made only for those expenditures which are not
19    claimable by the City under "An Act relating to fire
20    protection training", certified November 9, 1971, as
21    amended.
22        8. To administer General Revenue Fund grants to areas
23    not located in a fire protection district or in a
24    municipality which provides fire protection services, to
25    defray the organizational expenses of forming a fire
26    protection district.

1        9. In cooperation with the Illinois Environmental
2    Protection Agency, to administer the Illinois Leaking
3    Underground Storage Tank program in accordance with
4    Section 4 of this Act and Section 22.12 of the
5    Environmental Protection Act.
6        10. To expend state and federal funds as appropriated
7    by the General Assembly.
8        11. To provide technical assistance, to areas not
9    located in a fire protection district or in a municipality
10    which provides fire protection service, to form a fire
11    protection district, to join an existing district, or to
12    establish a municipal fire department, whichever is
13    applicable.
14        12. To exercise such other powers and duties as may be
15    vested in the Office by law.

17    Section 10. The Law Enforcement and Fire Fighting Medal of
18Honor Act is amended by changing Section 3001 as follows:
 
19    (20 ILCS 3985/3001)  (from Ch. 127, par. 3853-1)
20    Sec. 3001. There is created the Fire Fighting Medal of
21Honor Committee, referred to in this Article as the Committee.
22The Committee shall consist of the State Fire Marshal, the
23chief of the Chicago fire department and the following persons
24appointed by the Governor: 3 fire chiefs from other than

1Chicago, 3 representatives of statewide fire fighter
2organizations and 2 retired Illinois fire fighters. Of the
3appointed members, the fire chiefs shall each serve a 2-year
4term and the organization representatives and retired fire
5fighters shall each serve a one-year term. The Governor shall
6appoint initial members within 3 months of the effective date
7of this Act.
8    Members of the Committee shall serve without compensation
9but shall be reimbursed for actual expenses incurred in the
10performance of their duties from funds appropriated to the
11Office of the State Fire Marshal Office of the Governor for
12such purpose.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
