SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/18c-4701  from Ch. 95 1/2, par. 18c-4701

    Amends the Illinois Vehicle Code. Provides that an interstate carrier operating intrastate may operate a motor vehicle upon the public roads of this State without the authority number of the carrier painted or affixed to any side of the cab or power unit. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 18c-4701 as follows:
 
6    (625 ILCS 5/18c-4701)  (from Ch. 95 1/2, par. 18c-4701)
7    Sec. 18c-4701. Insignia on Vehicles.
8    (1) General Requirements to be Prescribed by Commission.
9Except as otherwise provided in this Section, no intrastate
10carrier shall operate any motor vehicle upon the public roads
11of this State unless there is painted or affixed to both sides
12of the cab or power unit, in accordance with such
13specifications as the Commission may prescribe, the trade name
14of the carrier as it appears on the carrier's license or the
15carrier's recognized logo, together with the license and
16registration number of the carrier. Likewise, no interstate
17carrier shall operate any motor vehicle upon the public roads
18of this State unless there is painted or affixed to both sides
19of the cab or power unit, in accordance with such
20specifications as the Commission may prescribe, the
21registration or authority number of the carrier. However, an
22interstate carrier operating intrastate may operate a motor
23vehicle upon the public roads of this State without the

1authority number of the carrier painted or affixed to any side
2of the cab or power unit.
3    (2) Use of ICC-Prescribed Identification. Identifying
4information prescribed by the Interstate Commerce Commission
5may be used in satisfaction of requirements established under
6this Section, including special orders granting a petition for
7waiver of Sections 1057.22(a) and 1057.22(c)(2) and (4), as
8they relate to equipment receipts, of the Lease and Interchange
9of Vehicle Regulations (49 CFR 1057), in lieu of numbers or
10symbols prescribed by the Commission.
11    (3) Identification of Trip Lessees. Notwithstanding any
12other provision of this Section to the contrary, a motor
13vehicle trip leased in accordance with this Chapter, Commission
14regulations and orders shall not be required to bear the name
15and license number of the lessee if:
16        (a) the motor vehicle bears the name and license or
17    registration number of the lessor in accordance with
18    subsection (1) of this Section, Commission regulations and
19    orders;
20        (b) the lessor and lessee are commonly-owned; and
21        (c) the vehicle carries a photocopy of a letter signed
22    by the lessor, on file with the Commission, stating that
23    the lessor and lessee are commonly-owned.
24    (4) Rules not superseded. The authority of the Illinois
25Commerce Commission to regulate the identification of motor
26vehicles of intrastate and interstate carriers, engaged in the

1transportation of hazardous materials, shall not supersede or
2replace the rules and regulations of the Illinois Department of
3Transportation and Federal Motor Carrier Safety regulations
4Part 390.21, as relates now or hereafter to the markings and
5identification of such vehicles.
6    (5) Identification on vehicles under 9,000 pounds gross
7vehicle weight (GVW). Vehicles with a gross vehicle weight
8(GVW) less than 9,000 pounds may, in lieu of identification
9required under subsection (1) of this Section display the trade
10name of the carrier as it appears on the carrier's license or
11the carrier's recognized logo, together with the license and
12registration number of the carrier in such manner as to be
13clearly legible and visible from both sides of the vehicle at a
14distance of 25 feet, when the vehicle is not in motion, and in
15accordance with such specifications as the Commission may
16prescribe.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.
