SYNOPSIS AS INTRODUCED:

305 ILCS 5/5-35 new

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that, for a person who is a resident in a facility licensed under the Specialized Mental Health Rehabilitation Act of 2013 or the Community-Integrated Living Arrangements Licensure and Certification Act for whom payments are made throughout a month and who is determined to be eligible for medical assistance, the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act so that the person's total monthly personal needs allowance from both State and federal sources equals $100. Provides that any additional income needed by facilities for the purpose of providing adequate care shall be supplemented by the State; and that the personal needs allowance shall increase annually at the same rate as the Social Security cost-of-living adjustment to take effect on January 1 of each following year. Effective immediately.

A BILL FOR

AN ACT concerning public aid.

WHEREAS, The State must provide Medicaid recipients who reside in a specialized mental health rehabilitation facility or a community-integrated living arrangement a monthly personal needs allowance deducted from their monthly Social Security income; and

WHEREAS, The national minimum monthly personal needs allowance for an individual is $30; and

WHEREAS, Over three-quarters of states in the United States have personal needs allowances that are more than the $30 minimum; and

WHEREAS, Illinois' monthly personal needs allowance is $30; and

WHEREAS, Illinois' personal needs allowance has not increased in accordance with Social Security cost-of-living adjustments since 1987; and

WHEREAS, Residents of specialized mental health rehabilitation facilities and community-integrated living arrangements depend on their personal needs allowance to live with independence and dignity as well as to save for moving out of the facility; therefore

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Public Aid Code is amended by adding Section 5-35 as follows:

Sec. 5-35. Personal needs allowance. For a person who is a resident in a facility licensed under the Specialized Mental Health Rehabilitation Act of 2013 or the Community-Integrated Living Arrangements Licensure and Certification Act for whom payments are made under this Article throughout a month and who is determined to be eligible for medical assistance under this Article, the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under Section 1902(q) of Title XIX of the Social Security Act (42 U.S.C. 1396a(q)) so that the person's total monthly personal needs allowance from both State and federal sources equals $100. Any additional income needed by facilities licensed under the Specialized Mental Health Rehabilitation Act of 2013 or the Community-Integrated Living Arrangements Licensure and Certification Act for the purpose of providing adequate care shall be supplemented by the State. The personal needs allowance shall increase annually at the same rate as the Social Security cost-of-living adjustment to take effect on January 1 of each following year.

Section 99. Effective date. This Act takes effect upon becoming law.
