2 | | AMENDMENT NO. ______. Amend House Bill 2448 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Illinois Vehicle Code is amended by |
5 | | changing Section 12-201 as follows:
|
6 | | (625 ILCS 5/12-201) (from Ch. 95 1/2, par. 12-201)
|
7 | | Sec. 12-201. When lighted lamps are required.
|
8 | | (a) When operated upon any highway in this State, every |
9 | | motorcycle shall at
all times exhibit at least one lighted |
10 | | lamp, showing a white light visible
for at least 500 feet in |
11 | | the
direction the motorcycle is proceeding. However, in lieu of |
12 | | such lighted
lamp, a motorcycle may be equipped with and use a |
13 | | means of modulating the
upper beam of the head lamp between |
14 | | high and a lower brightness. No such
head lamp shall be |
15 | | modulated, except to otherwise comply with this Code,
during |
16 | | times when lighted lamps are required for other motor vehicles.

1 | | (b) All other motor vehicles shall
exhibit at least 2 |
2 | | lighted head lamps, with at least one on each side
of the front |
3 | | of the vehicle, which satisfy United States Department of
|
4 | | Transportation requirements, showing white lights, including |
5 | | that emitted
by high intensity discharge (HID) lamps, or lights |
6 | | of a yellow or amber tint,
during the period from sunset to |
7 | | sunrise, at times when rain, snow, fog, or
other atmospheric |
8 | | conditions require the use of windshield wipers, and at
any |
9 | | other times when, due to insufficient light or unfavorable |
10 | | atmospheric
conditions, persons and vehicles on the highway are |
11 | | not clearly discernible at
a distance of 1000 feet. Parking |
12 | | lamps may be used in addition to but not in
lieu of such head |
13 | | lamps. Every motor vehicle, trailer, or semi-trailer shall
also |
14 | | exhibit at least 2 lighted lamps, commonly known as tail lamps, |
15 | | which
shall be mounted on the left rear and right rear of the |
16 | | vehicle so as to throw
a red light visible for at least 500 |
17 | | feet in the reverse direction, except that
a truck tractor or |
18 | | road tractor manufactured before January 1, 1968 and all
|
19 | | motorcycles need be equipped with only one such tail lamp.
|
20 | | (b-5) During all other times not specified under subsection |
21 | | (b) of this Section, when operated upon any highway in this |
22 | | State, every motor vehicle of the first division or motor |
23 | | vehicle of the second division weighing no more than 8,000 |
24 | | pounds shall at all times exhibit: (1) daytime running lights; |
25 | | or (2) at least 2 lighted head lamps, with at least one on each |
26 | | side of the front of the vehicle, and which satisfy United |

1 | | States Department of Transportation requirements, showing |
2 | | white lights, including those emitted by high intensity |
3 | | discharge (HID) lamps or lights of a yellow or amber tint. A |
4 | | violation of this subsection (b-5) is a business offense |
5 | | punishable by a fine of $100. |
6 | | For purposes of this subsection (b-5), "daytime running |
7 | | lights" means an automotive lighting device on the front of a |
8 | | motor vehicle that is automatically switched on when the |
9 | | vehicle is moving forward and emits a white, yellow, or amber |
10 | | light. |
11 | | (c) Either a tail lamp or a separate lamp shall be so |
12 | | constructed
and placed as to illuminate with a white light a |
13 | | rear registration plate
when required and render it clearly |
14 | | legible from a distance of 50 feet
to the rear. Any tail lamp |
15 | | or tail lamps, together with any separate
lamp or lamps for |
16 | | illuminating a rear registration plate, shall be so
wired as to |
17 | | be lighted whenever the head lamps or auxiliary driving lamps

18 | | are lighted.

19 | | (d) A person shall install only head lamps that satisfy |
20 | | United States
Department of Transportation regulations and |
21 | | show white light, including that
emitted by HID lamps, or light |
22 | | of a yellow or amber tint for use by a motor
vehicle.
