Amends the Environmental Protection Act. Provides that a person may sell or offer for sale at retail in the State any metal beverage container designed and constructed in such a manner that a part of the container is detachable in opening the container without the aid of a can opener if the part comprises substantially all of one of the ends of the metal beverage container.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Environmental Protection Act is amended by |
5 | | changing Section 21.2 as follows:
|
6 | | (415 ILCS 5/21.2) (from Ch. 111 1/2, par. 1021.2)

7 | | Sec. 21.2.
(a) After June 30, 1988, no person may sell or |
8 | | offer for sale
at retail in this State any metal beverage |
9 | | container acquired by the seller
or retailer after that date |
10 | | which is designed and constructed in such a
manner that a part |
11 | | of the container is detachable in opening the container
without |
12 | | the aid of a can opener , unless the part comprises |
13 | | substantially all of one of the ends of the metal beverage |
14 | | container .

15 | | (b) For purposes of this Section:
|
16 | | (1) "Beverage" means beer or other malt beverages, mineral |
17 | | water, soda
water or carbonated soft drinks, in liquid form and |
18 | | intended for human
consumption.

19 | | (2) "Metal beverage container" means any can or other |
20 | | container which is
composed exclusively or predominantly of |
21 | | metal or metallic alloys (except
those sold to interstate |
22 | | common carriers for use in passenger service) and
which |
23 | | contains or did contain a beverage.
