AMENDMENT TO HOUSE BILL 1914 




2    AMENDMENT NO. ______. Amend House Bill 1914 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Public Water District Act is amended  by 
5changing Section 9 as follows:
 



6    (70 ILCS 3705/9)  (from Ch. 111 2/3, par. 196)



7    Sec. 9. Every public water district organized under this 
8Act and every non-profit private water company is
authorized to 
9construct, maintain, alter and extend its water mains and 
10wastewater lines as a
proper use of highways along, upon, under 
11and across any highway, street,
alley or public ground in the 
12State, but so as not to inconvenience the
public use thereof, 
13and the right and authority are hereby granted to any
such 
14district or non-profit   private water company to construct, 
15maintain and operate any conduit or conduits,
water pipe or 
16pipes, wholly or partially buried or otherwise in, upon and

1along any of the lands owned by said State under any of the 
2public waters
therein; provided that the right, permission and 
3authority hereby granted
shall be subject to all public rights 
4of commerce and navigation and the
authority of the United 
5States in behalf of such public rights, and also to
the laws of 
6the State of Illinois to regulate and control the same.

8    Section 99. Effective date. This Act takes effect upon 
9becoming law.".
