AMENDMENT TO HOUSE BILL 1910

2    AMENDMENT NO. ______. Amend House Bill 1910 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Rescue Squad Districts Act is amended by
5adding Section 11.5 as follows:
 
6    (70 ILCS 2005/11.5 new)
7    Sec. 11.5. Emergency medical services tax.
8    (a) It is declared as a matter of public policy:
9        (1) that, in order to preserve, protect, and promote
10    the public health, safety, and general welfare, adequate
11    and continuing emergency medical services should be
12    available to every citizen of Illinois; and
13        (2) that, in the event adequate and continuing
14    emergency medical services do not exist, rescue squad
15    districts should be authorized to provide, and shall cause
16    to be provided, emergency medical services as a public

1    responsibility.
2    (b) If a rescue squad district incorporated under this Act
3is licensed under the Emergency Medical Services (EMS) Systems
4Act, then the rescue squad district may, under the terms and
5conditions set out in this Section, provide emergency medical
6services, including transport within or without the district.
7    The board of trustees of a rescue squad district
8incorporated under this Act may, under the terms and conditions
9set out in this Section, contract with providers of emergency
10medical services that are licensed under the Emergency Medical
11Services (EMS) Systems Act or enter into intergovernmental
12agreements with other units of local government for the purpose
13of providing emergency medical services that are licensed under
14the Emergency Medical Services (EMS) Systems Act.
15    The board of trustees of a rescue squad district
16incorporated under this Act may levy a tax for the provision of
17emergency medical services as provided in this Section and
18adopt rules and regulations relating to emergency medical
19services within its jurisdiction.
20    (c) If the board of trustees of a rescue squad district
21desires to levy a special tax to provide emergency medical
22services, then it shall certify the question to the proper
23election officials, who shall submit that question at an
24election to the voters of the district. The result of the
25referendum shall be entered upon the records of the district.
26If a majority of the votes on the proposition are in favor of

1the proposition, the board of trustees may then levy a special
2tax at a rate not to exceed 0.40% of the value of all taxable
3property within the district as equalized or assessed by the
4Department of Revenue. The proposition shall be in
5substantially the following form:

15    Votes must be recorded as "Yes" or "No".
16    (d) If it appears that a majority of all valid votes cast
17on the proposition are in favor of levying a special tax to pay
18for emergency medical services, the board of trustees may levy
19and collect an annual tax for the purpose of providing
20emergency medical services under this Act to be extended at a
21rate not to exceed 0.40% of the full fair cash value of the
22taxable property within the governmental unit as assessed or
23equalized by the Department of Revenue. This annual tax shall
24be in addition to the other taxes a rescue squad district may
25levy for its corporate purposes.
26    (e) Any board of trustees may:

1        (1) provide or operate an emergency medical services
2    subject to licensure under the Emergency Medical Services
3    (EMS) Systems Act;
4        (2) contract with a private person, hospital, or
5    corporation or enter into intergovernmental agreements
6    with one or more units of local government for the
7    provision and operation of emergency medical services or
8    subsidize the emergency medical services; however, the
9    provider of the emergency medical services must be licensed
10    under the Emergency Medical Services (EMS) Systems Act; and
11        (3) within its jurisdiction, fix, charge, and collect
12    fees for emergency medical services within or outside of
13    the rescue squad district not exceeding the reasonable cost
14    of the service.
15    (f) In this Section:
16    "Emergency medical services" includes, without limitation,
17pre-hospital care.
18    "Pre-hospital care" has the meaning given to that term in
19Section 3.10 of the Emergency Medical Services (EMS) Systems
20Act. "Pre-hospital care" includes emergency services performed
21by a paramedic or other on-board emergency personnel that are
22within the scope of the provider's license under the Emergency
23Medical Services (EMS) Systems Act.
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
