2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Code of Criminal Procedure of 1963 is |
5 | | amended by changing Section 124B-600 as follows: |

7 | | Sec. 124B-600. Persons and property subject to forfeiture. |
8 | | A person who commits the
the offense of computer fraud as set |
9 | | forth in Section 16D-5 or Section 17-50 of the Criminal Code of |
10 | | 1961 or the Criminal Code of 2012 shall forfeit any property |
11 | | that the sentencing court determines, after a forfeiture |
12 | | hearing under this Article, the person has acquired or |
13 | | maintained, directly or indirectly, in whole or in part, as a |
14 | | result of that offense. The person shall also forfeit any |
15 | | interest in, securities of, claim against, or contractual right |
16 | | of any kind that affords the person a source of influence over |
17 | | any enterprise that the person has established, operated, |
18 | | controlled, conducted, or participated in conducting, if the |
19 | | person's relationship to or connection with any such thing or |
20 | | activity directly or indirectly, in whole or in part, is |
21 | | traceable to any item or benefit that the person has obtained |
22 | | or acquired through computer fraud. |
