AMENDMENT TO HOUSE BILL 1317

2    AMENDMENT NO. ______. Amend House Bill 1317 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. The State Employees Group Insurance Act of 1971
5is amended by adding Section 18 as follows:
 
6    (5 ILCS 375/18 new)
7    Sec. 18. Waiver application prohibitions. Notwithstanding
8any other law to the contrary, the Director may not apply for
9any federal waiver that, if granted, would reduce or eliminate
10any protection or coverage required under the Patient
11Protection and Affordable Care Act (Public Law 111-148) that
12was in effect on January 1, 2017, including, but not limited
13to, any protection for persons with pre-existing conditions and
14coverage for services identified as essential health benefits
15under the Patient Protection and Affordable Care Act. The
16Director may apply for such a waiver only if the General

1Assembly, by joint resolution approved by a majority of each
2chamber, authorizes the Director to apply for a federal waiver
3prior to the submission of the waiver application to the U.S.
4Department of Health and Human Services.
 
5    Section 5. The Illinois Insurance Code is amended by adding
6Section 356z.25 as follows:
 
7    (215 ILCS 5/356z.25 new)
8    Sec. 356z.25. Waiver application prohibitions.
9Notwithstanding any other law to the contrary, the State may
10not apply for any federal waiver that, if granted, would permit
11an individual or group health insurance plan to reduce or
12eliminate any protection or coverage required under the Patient
13Protection and Affordable Care Act (Public Law 111-148) that
14was in effect on January 1, 2017, including, but not limited
15to, any protection for persons with pre-existing conditions and
16coverage for services identified as essential health benefits
17under the Patient Protection and Affordable Care Act. The State
18may apply for such a waiver only if the General Assembly, by
19joint resolution approved by a majority of each chamber,
20authorizes the State or an agency of the executive branch to
21apply for a federal waiver prior to the submission of the
22waiver application to the U.S. Department of Health and Human
23Services.

1    Section 10. The Illinois Public Aid Code is amended by
2adding Section 5-35 as follows:
 
3    (305 ILCS 5/5-35 new)
4    Sec. 5-35. Waiver application prohibitions.
5Notwithstanding any other law to the contrary, the State may
6not apply for any waiver of federal Medicaid requirements that,
7if granted, would reduce or eliminate any protection or
8coverage required under the Patient Protection and Affordable
9Care Act (Public Law 111-148) that was in effect on January 1,
102017. The State may apply for such a waiver only if the General
11Assembly, by joint resolution approved by a majority of each
12chamber, authorizes the State or an agency of the executive
13branch to apply for a federal waiver prior to the submission of
14the waiver application to the U.S. Department of Health and
15Human Services.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
