1 | | neuropsychiatric syndrome, including, but not limited to, the |
2 | | use of intravenous immunoglobulin therapy. A treatment that is |
3 | | administered or prescribed after July 18, 2017 shall be |
4 | | covered. |
5 | | For billing and diagnosis purposes, pediatric autoimmune |
6 | | neuropsychiatric disorders associated with streptococcal |
7 | | infections and pediatric acute onset neuropsychiatric syndrome |
8 | | shall be coded as autoimmune encephalitis until a code is |
9 | | assigned. Coverage under this Section may not be denied due to |
10 | | a diagnosis of autoimmune encephalopathy or autoimmune |
11 | | encephalitis. |
12 | | If, at any time, the Secretary of the United States |
13 | | Department of Health and Human Services, or its successor |
14 | | agency, promulgates rules or regulations to be published in the |
15 | | Federal Register or publishes a comment in the Federal Register |
16 | | or issues an opinion, guidance, or other action that would |
17 | | require the State, pursuant to any provision of the Patient |
18 | | Protection and Affordable Care Act (Public Law 111-148), |
19 | | including, but not limited to, 42 U.S.C. 18031(d)(3)(B) or any |
20 | | successor provision, to defray the cost of any coverage for |
21 | | pediatric autoimmune neuropsychiatric disorders associated |
22 | | with streptococcal infections and pediatric acute onset |
23 | | neuropsychiatric syndrome outlined in this Section, then the |
24 | | requirement that an insurer cover pediatric autoimmune |
25 | | neuropsychiatric disorders associated with streptococcal |
26 | | infections and pediatric acute onset neuropsychiatric syndrome |

1 | | is inoperative other than any such coverage authorized under |
2 | | Section 1902 of the Social Security Act, 42 U.S.C. 1396a, and |
3 | | the State shall not assume any obligation for the cost of |
4 | | coverage for pediatric autoimmune neuropsychiatric disorders |
5 | | associated with streptococcal infections and pediatric acute |
6 | | onset neuropsychiatric syndrome.
