1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by changing
5Sections 4-407 and 4-408 as follows:
 
6    (605 ILCS 5/4-407)  (from Ch. 121, par. 4-407)
7    Sec. 4-407. The Department may temporarily close to traffic
8any portion of a State highway for the purpose of constructing,
9repairing or making improvements thereon. When a portion of a
10State highway with a route marking is so closed, the Department
11shall arrange with local authorities or otherwise to maintain
12efficient detours around the portion of the State highway which
13is closed and, except for an unanticipated emergency as
14determined by the Department, shall post notice of the detour
15locations on the Department's website no later than 10 days
16before the detour becomes active. Such detour shall be plainly
17and conspicuously marked with signs by which traffic may be
18guided around that part of the highway so closed.

21    Sec. 4-408. The Department may, upon application by the
22proper authorities of any local governmental agency, issue a

1permit to such agency to temporarily close to traffic any
2portion of a State highway for any public purpose or for any
3temporary needs of such agency. Such permit shall be issued
4only upon the explicit agreement of the local governmental
5agency to assume all liabilities and pay all claims for any
6damages which shall be occasioned by such closing and such
7agreement shall be made a part of every such permit. When a
8State highway is closed by a local governmental agency under
9the terms of a permit, the agency shall maintain efficient
10detours satisfactory to the Department around the portion of
11the closed highway. Except for an unanticipated emergency as
12determined by the Department, the Department and the local
13governmental agency shall post notice of the detour locations
14on the Department's website and the local governmental agency's
15website no later than 10 days before the detour becomes active.
16A hyperlink on a local governmental agency's website to posted
17notices on the Department's website shall satisfy the
18requirements under this Section. A local governmental agency
19that does not have a website maintained by a full-time staff or
20a municipality with 1,000,000 or more inhabitants shall not be
21required to post detour locations under this Section. Such
22detour shall be plainly and conspicuously marked with signs by
23which traffic may be guided around that part of the State
24highway so closed.
