1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Highway Code is amended by changing | ||||||
5 | Sections 4-407 and 4-408 as follows:
| ||||||

7 | Sec. 4-407.
The Department may temporarily close to traffic | ||||||
8 | any portion
of a State highway for the purpose of constructing, | ||||||
9 | repairing or making
improvements thereon. When a portion of a | ||||||
10 | State highway with a route
marking is so closed, the Department | ||||||
11 | shall arrange with local authorities
or otherwise to maintain | ||||||
12 | efficient detours around the portion of the State
highway which | ||||||
13 | is closed and, except for an unanticipated emergency as | ||||||
14 | determined by the Department, shall post notice of the detour | ||||||
15 | locations on the Department's website no later than 10 days | ||||||
16 | before the detour becomes active . Such detour shall be plainly | ||||||
17 | and conspicuously
marked with signs by which traffic may be | ||||||
18 | guided around that part of the
highway so closed.

The Department may, upon application by the | ||||||
22 | proper authorities
of any local governmental agency, issue a |

1 | permit to such agency to
temporarily close to traffic any | ||||||
2 | portion of a State highway for any public
purpose or for any | ||||||
3 | temporary needs of such agency. Such permit shall be
issued | ||||||
4 | only upon the explicit agreement of the local governmental | ||||||
5 | agency to
assume all liabilities and pay all claims for any | ||||||
6 | damages which shall be
occasioned by such closing and such | ||||||
7 | agreement shall be made a part of every
such permit. When a | ||||||
8 | State highway is closed by a local governmental agency
under | ||||||
9 | the terms of a permit, the agency shall maintain efficient | ||||||
10 | detours
satisfactory to the Department around the portion of | ||||||
11 | the closed highway. Except for an unanticipated emergency as | ||||||
12 | determined by the Department, the Department and the local | ||||||
13 | governmental agency shall post notice of the detour locations | ||||||
14 | on the Department's website and the local governmental agency's | ||||||
15 | website no later than 10 days before the detour becomes active. | ||||||
16 | A hyperlink on a local governmental agency's website to posted | ||||||
17 | notices on the Department's website shall satisfy the | ||||||
18 | requirements under this Section. A local governmental agency | ||||||
19 | that does not have a website maintained by a full-time staff or | ||||||
20 | a municipality with 1,000,000 or more inhabitants shall not be | ||||||
21 | required to post detour locations under this Section.
Such | ||||||
22 | detour shall be plainly and conspicuously marked with signs by | ||||||
23 | which
traffic may be guided around that part of the State | ||||||
24 | highway so closed.
