Amends the Park District Code. Provides that a commissioner of a park district board shall not be elected to more than 2 terms. Further provides that the 2-term limit does not apply to a term where a commissioner is elected to a 6-year term but only serves a 2-year term as prescribed by statute.

|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Park District Code is amended by changing |
5 | | Sections 2-12 and 2-12a as follows:
|
6 | | (70 ILCS 1205/2-12) (from Ch. 105, par. 2-12)

7 | | Sec. 2-12.
Except as may be otherwise determined pursuant |
8 | | to Section 2-12a
the commissioners shall be elected for 6 year |
9 | | terms in all districts now
or hereafter organized with the |
10 | | exceptions provided in Sections 2-10 and
2-10a as to those |
11 | | first elected.

12 | | In all General Park Districts commissioners shall be |
13 | | elected biennially
to take the place of those whose terms |
14 | | expire. Such elections
shall take place at the election |
15 | | provided by the general election
law.
|
16 | | Commissioners shall serve until their successors are |
17 | | elected and qualified. A commissioner shall not be elected to |
18 | | more than 2 terms under this Section or Section 2-12a.

21 | | Sec. 2-12a.
Any district may provide, either by resolution |
22 | | of the board
or by referendum, that the term of commissioners |

1 | | shall be 4 years rather
than 6 years. Any such referendum shall |
2 | | be initiated and held in the same
manner as is provided by the |
3 | | general election law for public questions
authorized by Article |
4 | | VII of the Illinois Constitution.
|
5 | | If a majority of the votes cast on the proposition is in |
6 | | favor of a 4-year
term for commissioners, or if the Board |
7 | | adopts a resolution stating that
it is acting pursuant to this |
8 | | Section to change the term of office from
6 years to 4 years, |
9 | | commissioners thereafter elected, commencing with the
first |
10 | | regular park district election at least 60 days after the date |
11 | | on
which the proposition for 4-year terms was approved at |
12 | | referendum or by
resolution, shall be elected for a term of 4 |
13 | | years. In order to provide
for the transition from 6-year terms |
14 | | to 4-year terms, if 2 commissioners
are to be elected at the |
15 | | first such election and if the term of only one
commissioner is |
16 | | scheduled to expire in the year of the next election at
which |
17 | | commissioners are elected, of the 2 commissioners elected, one |
18 | | shall
serve a 2-year
term and one a 4-year term, to be |
19 | | determined by lot between the 2 persons
elected within 30 days |
20 | | after the election.

21 | | In any district where the board has created 4-year terms |
22 | | pursuant to
this Section, whether by referendum or by |
23 | | resolution, the length of terms
may later be increased to 6 |
24 | | years, but only by a referendum initiated and
held in the same |
25 | | manner as prescribed in this Section for creating 4-year
terms. |
26 | | No proposition to increase the terms of commissioners shall |
