| 3 | | line 4 on page 58 through line 3 on page 59 with the following:

| 4 | | "(a) Nothing in this Act exempts any physician, practice |
| 5 | | group, hospital, or institution from vicarious liability |
| 6 | | arising from the employment, agency, or apparent agency of a |
| 7 | | licensed certified professional midwife that commits an |
| 8 | | alleged negligent act or omission. |
| 9 | | (b) Nothing in this Act exempts any physician or practice |
| 10 | | group from liability for its own negligent acts or omissions |
| 11 | | arising out of its failure to supervise or oversee a licensed |
| 12 | | certified professional midwife, to the extent such a physician |
| 13 | | or practice group has undertaken to provide such oversight. |
| 14 | | (c) Nothing in this Act exempts a hospital or practice |
| 15 | | group from liability arising out of the credentialing or |
| 16 | | employment of a licensed certified professional midwife.".
