5 | | Section 12-5 and by adding Section 28-8.2 as follows:

8 | | (a) Except as otherwise provided in subsection (b), for all |
9 | | elections held after July
1, 1999, notice of public
questions |
10 | | shall be required only as set forth in this
Section and Section |
11 | | 28-8.2 of this Code or as set forth in Section 17-3 or 19-3 of |
12 | | the School Code. Not

5 | | posting a copy of the notice at the principal office of the |
6 | | election
authority. The local election official shall also post |
7 | | a copy of the notice at
the principal office of the political |
8 | | or governmental
subdivision, or if there is no principal office |
9 | | at the building in which the
governing body of the political or |
10 | | governmental subdivision held its first
meeting of the calendar |
11 | | year in which the referendum is being held. The
election |
12 | | authority and the political or governmental subdivision may, |
13 | | but are
not required to, post the notice electronically on |
14 | | their World Wide Web pages.
The notice, which shall appear over |
15 | | the name or title of the election
authority, shall be |
16 | | substantially in the following form:

17 | | NOTICE IS HEREBY GIVEN that at the election to be held |
18 | | on
(insert day of the week),
(insert date of election), the |
19 | | following proposition will be
submitted to the voters of |
20 | | (name of political or governmental subdivision):

21 | | (insert the public question as it will appear on the |
22 | | ballot)
|
23 | | The polls at the election will be open at 6:00 o'clock |

continue to be open until 7:00 o'clock P.M. |

2 | | The notice shall also include any additional information |
3 | | required by the statute authorizing the public question. The |
4 | | notice may include an explanation, in neutral and plain |
5 | | language, of the question and its purposes supplied by the |
6 | | governing body of the political or governmental subdivision to |
7 | | whose voters the question is to be submitted. The notice shall |
8 | | set forth the
precincts and polling places at which the |
9 | | referendum will be conducted only in
the case of emergency |
10 | | referenda. |
11 | | (b) Notice of any public question published in a local, |
12 | | community newspaper having general circulation in the |
13 | | political or governmental subdivision to which such public |
14 | | question and Section 28-8.2 of this Code relates more than 30 |
15 | | days but not more than 35 days prior to the general election |
16 | | held on November 8, 2016 that otherwise complies with the |
17 | | requirements of this Section is sufficient notice to satisfy |
18 | | the newspaper publication requirement of this Section, such |
19 | | notice shall for all purposes be deemed to have been given in |
20 | | accordance with this Section, any bonds approved by the voters |
21 | | at such election are hereby authorized to be issued in |
22 | | accordance with applicable law without further referendum |
23 | | approval and taxes to be levied pursuant to any limiting rate |
24 | | increases approved by the voters at such election are hereby |
25 | | authorized to be levied and extended without further referendum |
26 | | approval.

3 | | Sec. 28-8.2. Revenue referenda disclosure. |
4 | | (a) For purposes of this Section, "revenue referenda" means |
5 | | referenda by a unit of local government, including a school |
6 | | district, seeking to impose or increase a retailers' occupation |
7 | | tax, a use tax, a service occupation tax, a service use tax, or |
8 | | a property tax, or regarding the issuance of bonds. |
9 | | (b) If not already required by the Property Tax Extension |
10 | | Limitation Law, all revenue referenda shall have printed |
11 | | thereon, but not as part of the proposition submitted, only the |
12 | | following supplemental information (which shall be supplied to |
13 | | the election authority by the taxing district) in substantially |
14 | | the following form: |
15 | | (1) The approximate amount of taxes extendable at the |
16 | | most recently extended limiting rate is $...., and the |
17 | | approximate amount of taxes extendable if the proposition |
18 | | is approved is $.... |
19 | | (2) For the (insert the first full levy year for which |
20 | | the new rate or increased limiting rate will be applicable) |
21 | | levy year the approximate amount of the additional tax |
