| 2 | | AMENDMENT NO. ______. Amend House Bill 485, AS AMENDED, by |
| 3 | | replacing everything after the enacting clause with the |
| 4 | | following:
|
| 5 | | "Section 5. The State Officials and Employees Ethics Act is |
| 6 | | amended by changing Section 5-20 as follows:
|
| 7 | | (5 ILCS 430/5-20)
|
| 8 | | Sec. 5-20. Public service announcements; other promotional |
| 9 | | material.
|
| 10 | | (a) Beginning January 1, 2004, no public service |
| 11 | | announcement or
advertisement that is on behalf of
any State |
| 12 | | administered program and contains the
proper name, image, or |
| 13 | | voice of any executive branch constitutional officer
or member |
| 14 | | of the General Assembly shall be (i) broadcast or aired on |
| 15 | | radio or
television, (ii)
printed in a commercial newspaper or |
| 16 | | a commercial magazine, or (iii) displayed on a billboard or |

| 1 | | electronic message board at any
time.
|
| 2 | | (b) The proper name or image of any executive branch |
| 3 | | constitutional officer
or member of the General Assembly may |
| 4 | | not appear on any (i)
bumper stickers,
(ii) commercial |
| 5 | | billboards, (iii) lapel pins or buttons, (iv) magnets, (v)
|
| 6 | | stickers, and
(vi) other similar promotional items, that are |
| 7 | | not in furtherance of the person's official State duties or |
| 8 | | governmental and public service functions, if
designed,
paid |
| 9 | | for, prepared, or distributed using public dollars. This |
| 10 | | subsection does
not apply to stocks of items existing on the |
| 11 | | effective date of this amendatory
Act of the 93rd General |
| 12 | | Assembly.
|
| 13 | | (b-5) During a period beginning September 1 of the year of |
| 14 | | a general election and ending the day after the general |
| 15 | | election, the proper name, image, or voice of any executive |
| 16 | | branch constitutional officer or member of the General Assembly |
| 17 | | shall not be included in any public announcement related to the |
| 18 | | award of any contract or grant paid for with State dollars. |
| 19 | | Nothing in this subsection (b-5) prohibits: (i) a State |
| 20 | | agency from making a public announcement about the issuance of |
| 21 | | a grant or a contract, provided the public announcement does |
| 22 | | not include the proper name, image, or voice of any executive |
| 23 | | branch constitutional officer or member of the General |
| 24 | | Assembly; (ii) a legislative committee or commission from |
| 25 | | meeting and conducting business; or (iii) an executive branch |
| 26 | | constitutional officer or member of the General Assembly from |

| 1 | | attending any public or private event associated with the award |
| 2 | | or grant of contract or from being included on a list of |
| 3 | | attendees disseminated to the public. |
| 4 | | For purposes of this subsection (b-5), a "public |
| 5 | | announcement" means any written or oral statement disseminated |
| 6 | | to the public, by any medium, that is designed, paid for, |
| 7 | | prepared, or distributed using State dollars. |
| 8 | | (c) This Section does not apply to
communications
funded |
| 9 | | through expenditures required to be reported under Article 9 of |
| 10 | | the
Election Code.
