Synopsis As Introduced
Amends the Minimum Wage Law. Makes a technical change in a Section concerning the application of the Act.

House Floor Amendment No. 1
Deletes reference to:
820 ILCS 105/15
Adds reference to:
820 ILCS 260/10

Replaces everything after the enacting clause. Amends the Nursing Mothers in the Workplace Act. Provides for paid break time rather than unpaid break time. Deletes an exception permitting employers to not provide break time if providing break time would unduly disrupt the employer's operations. Requires an employer to provide reasonable break time to an employee that does not have a break within a 2.5 hour block of time. Effective July 1, 2018.

Senate Floor Amendment No. 3
Replaces everything after the enacting clause. Amends the Nursing Mothers in the Workplace Act. Provides for reasonable break time (instead of "unpaid break time each day") during the first year after the child's birth each time the employee needs to express milk. Provides that the break time may (instead of "must, if possible") run concurrently with any break time already provided to the employee. Provides that an employer may not reduce an employee's compensation for time used for the purpose of expressing milk or nursing a baby. Replaces language providing that an employer is not required to provide break time if to do so would unduly disrupt the employer's operations with language providing that an employer shall provide reasonable break time as needed by the employee unless to do so would create an undue hardship as defined by the Illinois Human Rights Act. Effective July 1, 2018.
